Juni 2004 … In der Patentnichtigkeitssache … - 2 - betreffend das europäische Patent 0 304 202 (DE 38 72 621) hat der 3. Senat (Nichtigkeitssenat) des Bundespatentgerichts auf Grund der mündlichen Verhandlung vom 29. Juni 2004 unter Mitwirkung des Vorsitzenden Richters Dipl.-Ing. Hellebrand sowie der Richter Dipl.-Chem. Dr. Niklas, Dipl.-Chem. Dr. Jordan, Brandt und Dipl.-Chem. Dr. Egerer für Recht erkannt: Das europäische Patent 0 304 202 wird mit Wirkung für das Ho-heitsgebiet der Bundesrepublik Deutschland für nichtig erklärt. Die Beklagte trägt die Kosten des Rechtsstreits. Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrages vorläufig vollstreckbar. T a t b e s t a n d Die Beklagte ist eingetragene Inhaberin des am 5. August 1988 unter Inanspruch-nahme der Prioritäten der englischen Patentanmeldungen GB 8803000 vom 10. Februar 1988 und GB 8700558 vom 6. August 1987 angemeldeten und ua mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland erteilten Europäi-schen Patents 0 304 202 (Streitpatent), das vom Deutschen Patent- und Marken-amt unter der Nummer 38 72 621 geführt wird. Das in der Verfahrenssprache Eng-lisch erteilte Streitpatent betrifft die "Determination of ambient concentrations of several analytes" und umfasst in der erteilten Fassung 11 Patentansprüche. Pa-tentanspruch 1 lautet in deutscher Übersetzung: - 3 - 1. Verfahren zur Bestimmung der umgebenden Konzentration mehrerer Analyten in einer flüssigen Probe mit einem Volumen von V Litern, das darin besteht, dass man ein Trägermittel mit mehreren unterschiedlichen Bindemitteln, von denen jedes zur reversiblen Bindung eines gegebenenfalls in der flüssigen Probe vorhandenen Analyten fähig und für je-nen Analyten im Vergleich mit den anderen Komponenten der flüssigen Probe spezifisch ist, an mehreren voneinander beab-standeten Stellen derart belädt, dass jede Stelle nicht mehr als 0,1 V/K Mol eines einzelnen Bindemittels aufweist, wobei K Li-ter/Mol die Gleichgewichtskonstante des Bindemittels bezüglich des Analysten darstellt; das beladene Trägermittel mit der zu analysierenden flüssigen Probe derart in Berührung bringt, dass jede der voneinander beabstandeten Stellen im gleichen Arbeitsgang mit der flüssi-gen Probe in Berührung gebracht wird, wobei die Menge der in der Probe eingesetzten Flüssigkeit derart ist, dass lediglich ein unwesentlicher Anteil an eventuell in der flüssigen Probe vor-handenem Analyten an das dafür spezifische Bindemittel ge-bunden wird, sowie eine die Teilbesetzung der Bindemittel an den voneinander be-abstandeten Stellen durch die Analyten darstellende Größe mit-tels einer kompetitiven oder nichtkompetitiven Testmethode un-ter Verwendung eines für jedes Bindemittel regiospezifischen Reagens misst, das dazu in der Lage ist, entweder die unbe-setzten Bindestellen oder die besetzten Bindestellen an dem Bindemittel zu erkennen, wobei jenes regiospezifische Reagens mit einem Marker markiert ist, wodurch sich die Menge jenes Reagens an der entsprechenden Stelle messen lässt. - 4 - Wegen des Wortlauts der auf Patentanspruch 1 mittelbar oder unmittelbar zurück-bezogenen Patentansprüche 2 bis 9 und der nebengeordneten Patentansprü-che 10 und 11 wird auf die Streitpatentschrift verwiesen. Die Klägerin macht geltend, das Streitpatent sei nicht patentfähig, weil es weder neu sei noch auf erfinderischer Tätigkeit beruhe und auch die Erfindung nicht so deutlich und vollständig offenbare, dass ein Fachmann sie ausführen kann. Die Klägerin beantragt, das europäische Patent 0 304 202 mit Wirkung für das Hoheitsge-biet der Bundesrepublik Deutschland für nichtig zu erklären. - 6 - Die Beklagte verteidigt das Streitpatent mit den Patentansprüchen 1 bis 11 in der Fassung gemäß mit Schriftsatz vom 9. Februar 2004 eingereichtem Haupt- und Hilfsantrag und beantragt, die Klage abzuweisen, soweit sie sich gegen die Patentansprüche in der Fassung gemäß Haupt- und Hilfsantrag richtet. Patentanspruch 1 gemäß Hauptantrag lautet: "1. A method for determining the ambient concentrations of a plurali-ty of analytes in a liquid sample of volume V litres, comprising loading a plurality of different binding agents, each being capable of reversibly binding an analyte which is or may be present in the liquid sample and is specific for that analyte as compared to the other components of the liquid sample, onto a support means at a plurality of spaced apart locations each having a size of less than 1 mm2 such that each location has not more than 0.1 V/K moles of a single binding agent, where K litres/mole is the equili-brium constant of the binding agent for the analyte; contacting the loaded support means with the liquid sample to be analysed, such that each of the spaced apart locations is contac-ted in the same operation with the liquid sample, the amount of li-quid used in the sample being such that only an insignificant pro-portion of any analyte present in the liquid sample becomes bound to the binding agent specific for it, and measuring a parameter representative of the fractional occupan-cy by the analytes of the binding agents at the spaced apart loca-tions by a competitive or non-competitive assay technique using a site-recognition reagent for each binding agent capable of re-cognising either the unfilled binding sites or the filled binding sites on the binding agent, said site-recognition reagent being la-- 7 - belled with a marker enabling the amount of said reagent in the particular location to be measured." Patentanspruch 1 gemäß Hilfsantrag lautet: "1. A method for determining the ambient concentrations of a plu-rality of analytes in a liquid sample of volume V litres, compri-sing loading a plurality of different binding agents, each being ca-pable of reversibly binding an analyte which is or may be pre-sent in the liquid sample and is specific for that analyte as compared to the other components of the liquid sample, onto a non-porous support means at a plurality of spaced apart loca-tions each having a size of less than 1 mm2 such that each lo-cation has not more than 0.1 V/K moles of a single binding agent, where K litres/mole is the equilibrium constant of the binding agent for the analyte; contacting the loaded support means with the liquid sample to be analysed, such that each of the spaced apart locations is contacted in the same operation with the liquid sample, the amount of liquid used in the sample being such that only an in-significant proportion of any analyte present in the liquid samp-le becomes bound to the binding agent specific for it, and measuring a parameter representative of the fractional occu-pancy by the analytes of the binding agents at the spaced apart locations by a competitive or non-competitive assay technique using a site-recognition reagent for each binding agent capable of recognising either the unfilled binding sites or the filled binding sites on the binding agent, said site-recogni-tion reagent being labelled with a marker enabling the amount of said reagent in the particular location to be measured." - 8 - Wegen des Wortlauts der jeweils auf Patentanspruch 1 mittelbar oder unmittelbar zurückbezogenen Patentansprüche 2 bis 9 sowie der nebengeordneten Patentan-sprüche 10 und 11 wird auf die Verfahrensakten verwiesen. Die Beklagte tritt dem Vorbringen der Klägerin entgegen und hält das Streitpatent in dem verteidigten Umfang für patentfähig. E n t s c h e i d u n g s g r ü n d e Die zulässige Klage erweist sich als begründet. Der geltend gemachte Nichtigkeitsgrund führt zur Nichtigerklärung des Streitpa-tents mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland, Art II § 6 Abs 1 Nr 1 Nr 2 IntPatÜG, Art 138 Abs 1 lit a), b), Art 52, 54, 56 EPÜ. I. 1. Das Streitpatent betrifft die Bestimmung der umgebenden Analytkonzentratio-nen in Flüssigkeiten, z.B. die Bestimmung von Analyten wie Hormone, Proteine und andere in biologischen Flüssigkeiten, wie Körperflüssigkeiten, natürlich vor-kommende oder künstliche vorhandene Substanzen. Nach der Streitpatentschrift wird dabei von der WO 84/01031 A1 ausgegangen, wonach die Konzentration ei-nes Analyten in einem Fluid über die Teilbelegung der Bindungsstellen am Binde-mittel bestimmt wird unter Einsatz nur einer Spurenmenge eines Bindemittels, zB eines für den Analyten spezifischen Antikörpers, so dass die Konzentration des freien (ungebundenen) Analyten durch die Zugabe des Bindemittels nicht wesent-lich herabgesetzt wird und die Teilbelegung der Bindungsstellen des Bindemittels vom absoluten Volumen des Fluids sowie von der Absolutmenge des Bindemittels unabhängig ist. Weiterer Ausgangspunkt ist die GB 2099578 A, in der eine Vor-richtung für Immunoassays mit an einer Mehrzahl von abgegrenzten Stellen eines porösen Trägers gebundenen Antigenen oder Immunoglobulinen zur Erstellung ei-nes Antikörperprofils einer Blutprobe offenbart wird, wobei die Menge an Antigen pro Stelle allerdings genügend gross sein muss, um die gesamte Menge des Ana-lyten zB. Antikörper zu binden (Streitpatentschrift S 2 Z 11 bis Seite 3 Z 24). - 10 - 2. Die Aufgabe des Streitpatents soll darin bestehen, Immunoassays mit hoher Empfindlichkeit bereitzustellen (vgl Streitpatentschrift S 3 Z 28 bis 29). 3. Zur Lösung beschreibt Patentanspruch 1 in der gemäß Hauptantrag verteidigten Fassung 1. A method for determining the ambient concentrations of a plu-rality of analytes in a liquid sample of volume V litres, comprising 2. loading a plurality of different binding agents onto a support means at a plurality of spaced apart locations, 2.1 each binding agent is capable of reversibly binding an analyte which is or may be present in the liquid sample and is specific for that analyte as compared to the other components of the li-quid sample, 2.2 each location has a size of less than 1 mm2 2.3 such that each location has not more than 0.1 V/K moles of a single binding agent, where K litres/mole is the equilibrium constant of the binding agent for the analyte, 3. contacting the loaded support means with the liquid sample to be analysed, such that each of the spaced apart locations is contacted in the same operation with the liquid sample, 4. the amount of liquid used in the sample being such that only an insignificant proportion of any analyte present in the liquid sample becomes bound to the binding agent specific for it, 5. measuring a parameter representative of the fractional occu-pancy by the analytes of the binding agents at the spaced apart locations by a competitive or non-competitive assay technique, 5.1 using a site-recognition reagent for each binding agent capa-ble of recognising either the unfilled binding sites or the filled binding sites on the binding agent, - 11 - 5.2 said site-recognition reagent being labelled with a marker en-abling the amount of said reagent in the particular location to be measured. Gelöst wird die Aufgabe gemäß Patentansprüchen 10 sowie 11 in der gemäß Hauptantrag verteidigten Fassung des weiteren durch A) a device for use in determining the ambient concentrations of a plurality of analytes in a liquid sample of volume V litres, comprising B) a solid support means C) having located thereon at a plurality of spaced apart loca-tions a plurality of different binding agents, C.1) each location having a size of less than 1 mm, C.2) each location having not more than 0.1 V/K moles of a single binding agent, where K litres/mole is the equilibrium constant of that binding agent for reaction with the analyte to which it is specific, C.3) each binding agent being capable of reversibly binding an analyte which is or may be present in the liquid sample and is specific for that analyte as compared to the other compo-nents of the liquid sample. sowie durch a) a kit for use in determining the ambient concentration of a plurality of analytes in a liquid sample of volume V litres, b) a solid support means, c) having located thereon at a plurality of spaced apart loca-tions a plurality of different binding agents, c.1) each location having not more than 0.1 V/K, preferably less than 0.01 V/K, moles of a single binding agent, where K li-- 12 - tres/mole is the equilibrium constant of that binding agent for reaction with the analyte to which it is specific, d) each binding agent being capable of reversibly binding an analyte which is or may be present in the liquid sample and is specific for that analyte as compared to the other compo-nents of the liquid sample, e) a plurality of standard samples containing known concentra-tions of the analytes whose concentrations in the liquid sample are to be measured, f) a set of labelled site-recognition reagents for reaction with filled or unfilled binding sites on the binding agents. II. Der Gegenstand der Patentansprüche 1 bis 11 der gegenüber dem Streitpatent geänderten Fassungen gemäß Haupt- und Hilfsantrag erweist sich als nicht pa-tentfähig, da er gegenüber der Druckschrift K23 in Verbindung mit den Druck-schriften K26 sowie HE-10 nicht auf erfinderischer Tätigkeit beruht. 1. Die Änderungen in der Fassung gemäß Hauptantrag gegenüber der erteilten Fassung durch Einschränkung der Gegenstände der Patentansprüche 1 bis 9 so-wie 10 und 11 durch Aufnahme jeweils des Merkmals 2.3 betreffend die Spotgrö-ße für ein Bindemittel von weniger als 1 mm2 ergeben sich unmittelbar aus der Be-schreibung des Streitpatents (vgl S 6 Z 4 bis 6) und sind zulässig. Auch das in den Patentansprüchen gemäß Hilfsantrag demgegenüber hinzuge-nommene Merkmal "non-porous support" ergibt sich aus der Beschreibung des Streitpatents (vgl S 5 Z 1 bis 2) und ist daher zulässig. - 13 - 2. Die Ausführbarkeit der Lehre des Streitpatents, die seitens der Klägerin hin-sichtlich Größe und Anzahl von Microspots in sogenannten Microarrays mit 1000 und mehr Bindemittelspots bemängelt wird (vgl Schrifts d Kl v 15. Oktober 2003 S 33 bis 34), ist anzuerkennen. Denn am Prioritätstag des Streitpatents standen sowohl handelsübliche Mikropipetten bzw. -spritzen, beispielsweise von der Firma Hamilton mit Auftragsvolumina von 0,1 Microliter, als auch geeignete handelsübli-che Träger zur Verfügung (vgl K16 S 6 Z 61 bis 63, entgegen Schrifts d Kl v 15. Oktober 2003 S 22 Abs 2 bis S 23 Abs 1). Darüber hinaus gibt die Druck-schrift HE-10 die Anleitung, aus kommerziellen Mikropipetten aus Glas dünnere Pipetten herzustellen, mit deren Hilfe dann sogar so geringe Volumina wie 5 Na-noliter auf geeignete Glasträger applizierbar sind (vgl HE-10 Sp 5 Z 20 bis 30). Zudem kann wegen BGH GRUR 2001, 813 – Taxol dahinstehen, ob das bean-spruchte Verfahren für jedwede Größenordnung von Bindemittelspots und damit verbunden nicht nur für jedwede Variante eines Immunoassays sondern auch für jedwedes Paar aus Bindemittel und Analyt beliebiger natürlicher oder syntheti-scher chemischer Verbindungen oder biologischen Materials ausführbar ist. 3. Dem Gegenstand des Streitpatents nächstliegend ist jener Stand der Technik, der sich aus der vorveröffentlichten Druckschrift K23 ergibt. Die K23 beschreibt unter anderem die Simultanbestimmung einer Mehrzahl von Analyten in einem Probenvolumen mittels für die jeweiligen Analyten spezifischer, voneinander beabstandet auf einem Träger gebundener Antikörper als Bindemittel und damit die Merkmale 1, 2, 2.1 und 3 (vgl K23 S 235 Z 6 bis 9 iVm Fig 11 a,b nebst Legende). Als zur Detektion besonders vorteilhaft wird darin die Fluores-zenztechnik herausgestellt, wobei in einem nicht-kompetitiven Testverfahren durch Zugabe einer Mischung von für jedes Bindemittel spezifisch fluoreszenzmarkierter anti-idiotypischer Antikörper als Reagenz die Teilbesetzung der Bindemittel durch die betreffenden Analyten ermittelt und hieraus die Analytkonzentration bestimmt werden kann (Merkmale 5, 5.1 und 5.2 – vgl K23 S 235 Z 6 bis 12, bes Z 9 bis 12 iVm S 233 von unten gezählte Z 9 bis 2). - 14 - Das Merkmal 4 ergibt sich für den Fachmann aus der K23 bereits aus dem Hin-weis, nur eine verschwindend kleine Bindemittelmenge einzusetzen in Verbindung mit dem diesbezüglichen Querverweis auf die britische Priorität 8224600 der K26 und dem dort näher beschriebenen sogenannten "ambient analyte immunoassay" (vgl K23 S 233 Mitte d le Abs), wonach sich die Menge bzw. die Konzentration des zu bestimmenden Analyten beim Bindungstest nur unwesentlich ändern darf (vgl K26 Anspr 1). Bei in nur sehr geringer Menge bzw. Konzentration in Körperflüssigkeiten vorkom-menden Analyten impliziert diese Vorbedingung ein geeignetes, ausreichendes Probenvolumen. Ob sich unmittelbar aus der K23 auch eine Spotgröße von weniger als 1 mm2 (Merkmal 2.2) sowie eine Bemessungsregel
