communicated on 17 June 2024
SUBJECT MATTER OF THE CASE
The applications mainly concern the decisions of the prison authorities to prohibit visits and/or telephone calls at weekends. The applicants who were detained in various prisons mainly complain of their inability to maintain contact with their school-age children on account of the said prohibition. In application no. 7331/21, besides the applicant’s complaint as to the restriction of the weekend visits, he also complains of the recording and storage of his private correspondence in the National Judicial Network System (UYAP). Lastly, the applicants in applications nos.44263/20, 45071/20, 51422/20, 52089/20, 55323/20 and 27046/21, further complain of their conditions of detention, in particular overcrowding.
Invoking Article 8 of the Convention, the applicants all allege a breach of their right to respect for their private and family life and correspondence. Relying on Article 3 of the Convention, the applicants in applications nos. 44263/20, 45071/20, 51422/20, 52089/20, 55323/20 and 27046/21, also complain of the inadequate conditions of their detention.
QUESTIONS TO THE PARTIES
CASE-SPECIFIC QUESTION IN RESPECT OF THE ADMISSIBILITY OF APPLICATION NO. 8253/21
Has the application been lodged with the Court in accordance with the six-month time-limit pursuant to Article 35 § 1 of the Convention (see Sabri Güneş v. Turkey [GC], no. 27396/06, §§ 39-42, 29 June 2012)? In particular, when was the decision of the Constitutional Court of 16 July 2020 served on the applicant by the prison administration?
COMMON QUESTIONS

Has there been an interference with the applicants’ right to respect for their private and family life and correspondence, within the meaning of Article 8 § 1 of the Convention, on account of the impugned restrictions on weekend visits and telephone calls (see Subaşı and Others v. Türkiye, nos. 3468/20 and 18 others, §§ 77-79 and 105, 6 December 2022)?
2. If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2 of the Convention? In particular, did the domestic authorities make a concrete assessment of the applicants’ needs and engage with their complaints in accordance with the guarantees inherent in Article 8 of the Convention (ibid., §§ 80-93 and 106‑09)?

Turkey, no. 49341/18 and 13 others, § 82, 29 March 2022)?
