SUBJECT MATTER OF THE CASE
The application concerns the non-enforcement of the domestic courts’ judgments establishing contact arrangements between the applicant and his two minor children. The applicant’s separate action against the enforcement authorities complaining about the bailiffs’ alleged inaction was dismissed by the domestic courts.
Relying on Articles 6 and 8 of the Convention, the applicant complains that, due to his former spouse’s obstructive attitude, he was unable to effectively exercise his contact rights and that the domestic authorities failed to take adequate measures in order to facilitate his contact with his children.
QUESTIONS TO THE PARTIES
1. Has there been a violation of the applicant’s right to respect for his family life, contrary to Article 8 of the Convention? In particular, having regard to their positive obligations under Article 8, have the domestic authorities provided sufficient assistance to the applicant for an effective enforcement of his contact rights (see, for example, Strumia v. Italy, no. 53377/13, 23 June 2016; E.K. v. Latvia, no. 25942/20, 13 April 2023; and I.S. v. Greece, no. 19165/20, 23 May 2023)?
