Anonimna predstavka
Neotkrivanje identiteta u predstavci Evropskom sudu: neprihvatljiva
Činjenice – Podnosilac predstavke je uhapšen zbog sumnje da je počinio više kaznenih djela. On je odbio da otkrije svoj identitet, te je bio je pritvoren ukupno sedam dana kako bi njegov identitet mogao biti ustanovljen. Žalbe koje je uložio protiv takvog lišavanja slobode su bile odbačene. Nakon toga, podnosilac predstavke se obratio Evropskom sudu žaleći se na kršenje članova 5, 6 i 14. Konvencije.
Pravo – Član 35. stav 2. tačka (a): identitet podnosioca predstavke nije otkriven. Ni u jednom od dokumenata koji su dostavljeni nije naznačeno njegovo ime. Samo je naznačen naziv “Blondje alias NN cel 07 alias Nn.PI09.m.20081101.1100”, a punomoć koja je dostavljena je potpisao “X”. Budući da spis nije sadržavao nijedan element koji bi omogućio Sudu da identificira podnosioca predstavke, predstavka se smatra anonimnom.
Zaključak: neprihvatljiva (anonimna predstavka).
