Having regard to the above application lodged on 17 May 2017,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Petru Bosînceanu, was born in 1967.
The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”), the friendly settlement procedure being set in motion through the offices of the Registrar upon communication.
By a letter received on 1 June 2022, the applicant expressed his intention to accept the proposal, but he failed to submit the formal declaration duly dated and signed, as required. By letters of 12 September 2022 and 21 December 2022, he was invited to do so by 10 October 2022 and 18 January 2023, respectively. No reply was received by the Court from the applicant within the provided deadlines.
By a letter sent by registered post on 22 September 2023, the applicant was again invited to submit the formal declaration, duly dated and signed, as required, by 20 October 2023. The registered letter returned to the Court as “recipient moved from address”; there are no previous letters from the applicant informing the Court about the change of address.
THE LAW
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
