Having regard to the above application lodged on 25 April 2023,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Aleš Cokan, was born in 1953.
The applicant’s complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 alone and in conjunction with Article 13 of the Convention concerning the extraordinary measures by national bank cancelling shares and bonds and the continuous absence of legal avenue for challenging these measures were communicated to the Slovenian Government (“the Government”).
By letter dated 22 January 2024 the applicant was requested to appoint a representative in accordance with Rule 36 §§ 2 and 4 of the Rules of Court by 28 March 2024. The applicant failed to do so. By letter dated 3 April 2024, sent by registered post, the applicant was again requested to designate a representative by 2 May 2024. The applicant’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant received that letter on 22 April 2024. However, no response has followed.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
