I ■ Background and purpose o f the Communica t i o n
1. This Communicat ion i s based on:
- A r t i c l e 35 o f the second Lomé Convent ion , which s t a t e s :
"Be fo re the e x p i r y o f the p e r io d r e f e r r e d t o i n A r t i c l e 31, the
Counci l o f M i n i s t e r s s h a l l dec ide on the use o f any ba lance remain ing
f rom the o v e r a l l amount e s ta b l i s h e d i n A r t i c l e 31, as w e l l as on the
c o n d i t i o n s f o r f u r t h e r use o f any amounts s t i l l t o be r e p le n is h e d
by the ACP S ta tes under A r t i c l e s 42 and 43, f o l l o w i n g the e x p i r y o f
the p e r io d r e f e r r e d t o i n A r t i c l e 31."
- The second paragraph o f A r t i c l e 8 o f Dec is io n 2/85 o f the
ACP-EEC Counc i l o f M i n i s t e r s o f 22 February 1985, conce rn ing
t r a n s i t i o n a l measures t o app ly f rom 1 March 1985, which p r o v id e s :
" A r t i c l e 35 o f the s a id Convent ion s h a l l c o n t in u e t o a p p l y , except
f o r the d u r a t i o n t h e r e o f , which s h a l l be extended u n t i l the t h i r d
ACP-EEC Convent ion e n te rs i n t o f o r c e . "
- Dec is ion 7/85 o f the ACP-EEC Counc i l o f M i n i s t e r s o f 21 June 1985,
which de lega ted t o the ACP-EEC Committee o f Ambassadors powers to
take a d e c i s i o n under A r t i c l e 35 o f the second Lomé Convent ion .
2. For the p a r t o f the d e c i s i o n which dea ls w i t h the use o f the Stabex
ba lance , regard shou ld be had:
(a) to A r t i c l e 2 o f D ec is ion 7/85 which s t a t e s "Any balance r e f e r r e d
to i n A r t i c l e 35 o f the second Convent ion s h a l l be rese rved f o r
the payment o f an a d d i t i o n a l share o f the amounts wh ich , a t the
end o f the f i n a n c i a l years r e l a t i n g t o the 1980 and 1981 years
o f a p p l i c a t i o n , a f t e r compensat ion o f rep len ishm ent c la im s and
t a k i n g i n t o account the m o b i l i z a t i o n o f a l l a d d i t i o n a l resources
under the s a id year o f a p p l i c a t i o n , had not been c o v e r e d . "
(b) t o the f a c t t h a t when a d o p t ing the d e c i s i o n , the Counc i l o f M i n i s t e r s
noted i n i t s c o n c lu s io n s t h a t account shou ld be t a k e n , i n d e c id in g

3. The p re sen t Communicat ion c o n ta in s p roposa ls t o the Member S ta tes
re g a rd in g the p o s i t i o n t o be taken on the ACP-EEC Committee o f Ambassadors
concern ing the d e c i s i o n on:
- use t o be made o f the b a la n c e , hav ing regard t o the c o n s id e r a t i o n s in
paragraph 2;
- use t o be made subsequen t ly o f the amounts s t i l l t o be r e p a id by the
ACP S ta tes a f t e r e x p i r y o f the second Lomé Convent ion .

4. A number o f p o in t s need to be covered:
- the s i z e o f the balance remain ing at the end o f Lomé I I ;
- the purpose f o r which the money i s to be used;
- the fo rm u la f o r apport ionment o f the balance among e l i g i b l e ACP S ta te s ;
- the payment c o n d i t i o n s ;
- the na tu re o f payments.
(a) Size o f balance and purpose f o r which money i s t o be used
5. Annex 1 to t h i s Communication shows the f i n a l balance l e f t over from
the Lomé I I Stabex fund a f t e r a p p r a i s a l o f a l l t r a n s f e r a p p l i c a t i o n s
r e l a t i n g t o the l a s t a p p l i c a t i o n year (1984). The t o t a l i s 127 180 016 ECU.
6 . A r t i c l e 2 o f Dec is ion 7/85 o f the ACP-EEC Counci l o f M i n i s t e r s i s
c l e a r as t o the purpose f o r which t h i s money i s t o be used: the whole sum
must be used in p a r t i a l compensat ion o f the e f f e c t s o f the 1980 and 1981
s h o r t f a l l . This means:
- none o f the money can be used in any o th e r o f the ways which might
have been c ons ide red ;
- i t must be app o r t ion e d s o l e l y between ACP S tates whose j u s t i f i e d ^
t r a n s f e r a p p l i c a t i o n s f o r 1980 and 1981 were not covered i n f u l l .
There are 28 o f these c o u n t r i e s , l i s t e d i n Annex IV ; 19 o f them are
l e as t -de v e lop e d c o u n t r i e s (LLDCs) w i t h i n the meaning o f the f i r s t paragraph
o f A r t i c l e 255 o f Lomé I I I . In a l l , 43 t r a n s f e r s are i n v o l v e d , 27 o f
them to LLDCs.
(b) Formula f o r apport ionment
7. The Committee o f Ambassadors i s r e q u i re d t o a p p o r t i o n the a v a i l a b l e
127 180 016 ECU between 28 c o u n t r i e s , t a k i n g i n t o account :
- the amounts not covered by the t r a n s f e r s made i n f a v o u r o f the c o u n t r i e s
concerned ;
- the need t o g ive more generous t rea tm en t to l e a s t -d e v e lo p e d ACP S ta tes .
We t h e r e f o r e need to agree on an es t im a te o f the amounts not covered and a fo rmu la f o r
apport ionment which takes account o f the second o f these c r i t e r i a .
Note t h a t because o f the " s a f e t y n e t " f o r r e d u c t io n s some o f the
a p p l i c a t i o n s f o r the two y e a r s , t o t a l l i n g 5 124 345 ECU, were covered
i n f u l l .

( i ) The amounts no t covered
8. These amounts can be assessed by measur ing the d i f f e r e n c e , w h e r e a t r a n s f e r
had t o be reduced, between the j u s t i f i e d request and the a c tu a l
payment.
A r t i c l e 2 o f Dec is ion 7/85 o f the ACP-EEC Counc i l o f M i n i s t e r s o f
21 June s p e l l s ou t what i s meant by:
- j u s t i f i e d re q u e s ts : the sum o f reques ts acknowledged a f t e r a p p r a i s a l
t o be j u s t i f i e d (714 214 774 ECU), less amounts o f f s e t by rep len ishm ent
c la im s (25 787 209 ECU) and reques ts f o r which payment was made in f u l l
(5 124 345 ECU), which g iv e s a t o t a l o f 683 303 220 ECU;
- a c tu a l t r a n s f e r s : a c tu a l t r a n s f e r s app roved , i n c l u d i n g the a d d i t i o n a l
resources made a v a i l a b l e under the L i b r e v i l l e d e c i s i o n , which t o t a l
315 705 270 ECU.
9. The t o t a l sum o f the amounts not covered(see Annex I I ) i n c r e a s e s t h e r e f o r e t o
367 597 950 ECU ; i t can be p a r t i a l l y o f f s e t by the 127 180 016 ECU ba lance
l e f t a t the end o f the Conven t ion .
( i i ) A p p o r t i onment
10. Annex I I shows how the amounts not covered have v a r i e d depending on the
year (1980 o r 1981) and the ca tego ry o f c o un t ry (LLDC o r o t h e r ACP)
concerned.
The v a r i a t i o n i n t h e amounts not c o v e r e d , i n terms o f pe rcen tage r e d u c t i o n o f the
j u s t i f i e d r e q u e s t , i s shown i n the f o l l o w i n g t a b l e :

11. Note t h a t (a) the o v e r a l l re d u c t io n was l a r g e r in 1981 than in 1980,
57.5% a ga in s t 47.8%, and (b) the LLDCs' p r e f e r e n t i a l edge was c o ns id e ra b ly
less in 1981, when the cu t a p p l ie d to the o th e r ACP was o n ly 9% g r e a t e r ,
than i n 1980, when the d i f f e r e n t i a l was 30%.
As th e amounts not covered by the t r a n s f e r requests p resen ted by the l e a s t
developed ACP S ta tes are r e l a t i v e l y s m a l le r than those f o r the o r d i n a r y ACP
S ta te s , i t would be u n f a i r s im p ly t o a p p o r t i o n the balance i n p r o p o r t i o n to
the amounts not compensated f o r the c lose o f the 1980/1981 e x e r c i s e .
12. Another fo rm u la must be sought , based on the Lomé I I I n e g o t i a t i o n s
which produced A r t i c l e 1 5 5 (3 ) (c ) o f the new C o n v e n t i o n , but t a k i n g
i n t o account the l i m i t e d funds a v a i l a b l e .
13. A c c o r d in g l y , we propose the f o l l o w i n g approach, t a k i n g account o f
two f a c t o r s (see Annex I I I f o r d e t a i l e d c a l c u l a t i o n s ) :
- a v a i l a b l e cash: the 127 180 016 ECU balance w i l l reduce the o v e r a l l
cu t f o r 1980/1981 f rom 53.8% to 35.2%;
- p r e f e r e n t i a l t r e a tm e n t f o r LLDCS: the f i n a l re d u c t i o n f o r the two
c a te g o r ie s o f c o un t ry w i l l correspond t o the p re fe rence enshr ined in
A r t i c l e 1 5 5 (3 ) ( c ) o f Lomé I I I - i . e . the cu t w i l l be 30% g r e a te r f o r
o r d i n a r y ACPs than f o r LLDCS.^
14. The a c tu a l r e d u c t io n s *-L work out a t :
- 28.6% f o r LLDCs, which i s w i t h i n the 30% l i m i t se t i n A r t i c l e 1 5 5 ( 3 ) ( c ) ;
- 37.2% f o r o th e r ACPs, aga in w i t h i n the 40% l i m i t s e t .
A r t i c l e 1 5 5 (3 ) ( c ) reads : " I n no case s h a l l the r e d u c t i o n o f each
t r a n s f e r b as is r e f e r r e d t o i n (a) exceed:
- 30% f o r the ACP S ta tes l i s t e d i n A r t i c l e s 257 and 260, ( f o r the second
a r t i c l e f o o t n o t e n° 2 r e f e r s ) .
- 40% f o r the o th e r ACP S t a t e s . "
A r t i c l e 1 5 5 ( 3 ) (c ) r e f e r s t o le as t -de ve lop e d c o u n t r i e s ( A r t i c l e 257) and
land locked c o u n t r i e s ( A r t i c l e 260). This does not a f f e c t the outcome o f
apport ionment in t h i s case, s ince a l l the land locked c o u n t r i e s concerned
are a ls o LLDCs, so the two c a te g o r ie s o v e r l a p .
'The r a t i o o f 1 :3 i s the same as t h a t worked ou t f o r the 1980 a p p l i c a t i o n
yea r .

15. The r e s u l t s o f a p p l i c a t i o n o f the fo rm u la are se t out i n Annex IV .
They are summarized by ca tego ry o f c o u n t ry i n the t a b l e o v e r l e a f
( 6a ) , and show t h a t :
- a p p l i c a t i o n o f the Stabex ba lance r a i s e s the o v e r a l l cover r a t e f rom
46.2% to 64.8%;
- the appor t ionment fo rm u la r a i s e s the LLDCs' cover r a t e f rom 54.9% to
71.4% and the r a te f o r the o th e r ACPs f rom 43.5% to 62.8%.
(c ) C o nd i t io n s and n a tu r e o f payments
16. We propose t h a t the Lomé I I payment p rocedure be f o l l o w e d :
- c o nc lu s io n o f a f i n a n c i n g agreement between the Commission and each
ACP S ta te concerned ( A r t i c l e 4 0 ( 2 ) ) ;
- i n d i c a t i o n o f p robab le use o f t r a n s f e r , i n compl iance w i t h the o b j e c t i v e s
o f the system ( A r t i c l e 41(1) and ( 2 ) ) ;
- r e p o r t t o be su bm i t te d w i t h i n tw e lve months o f the s i g n i n g o f the t r a n s f e r
agreement ( A r t i c l e 4 1 ( 3 ) ) .
- r e c o n s t i t u t i o n o f funds t r a n s f e r r e d , a c c o r d i n g t o the r u l e s a t a r t i c l e s 42 t o 44.
17. F o l low ing the usua l Lomé I I p rocedu re , the ACP S ta tes w i l l a l s o have
t o s t a t e the European c u r re ncy o r c u r r e n c ie s i n which payment shou ld be
made, and the number o f the bank account t o be c r e d i t e d .
( d ) O f f s e t t i n g repayments
18. Some o f the ACP S ta tes r e c e i v i n g a share o f the Stabex ba lance a re r e q u i r e d
t o c o n t r i b u t e t o the r e c o n s t i t u t i o n o f t h e system i n accordance w i t h t h e p r o v i
s ions o f A r t i c l e s 42 and 43 o f Lomé I I .Some c o u n t r i e s have f o r c e r t a i n amounts
f u l f i l l e d th e c o n d i t i o n s l a i d down a t t h e f o r e g o in g and have thus been o b l i g e d
to r e c o n s t i t u t e . B y ana logy w i t h the ad hoc measures approved by the ACP-EEC Counc i l
a t L i b r e v i l l e and the second in d e n t o f A r t i c l e 174(2) o f Lome I I I ( 1 ) , i t i s
proposed to se t t h e repayments due f rom these c o u n t r i e s a g a in s t t h e i r
e n t i t l e m e n t t o a share o f the Stabex b a la n ce . I n so f a r as the compensat ion
w i l l be aimed a t t h e r e c o n s t i t u t i o n o b l i g a t i o n s , which have been e s t a b l i s h e d
and made known t o the ACP S ta te concerned , and which a re due s o l e l y a t a l a t e r
d a te , the s a id o b l i g a t i o n s w i l l be c a l c u l a t e d t a k i n g i n t o c o n s i d e r a t i o n the
a c tu a l va lues o f the co r re spo n d ing amounts.
19. In l i n e w i t h t h e L i b r e v i l l e d e c i s i o n and A r t i c l e 174 o f Lomé I I I , t h e r e f o r e ,
the sum i n t h e t r a n s f e r agreement would be i n t h i s case th e net sum rem a in ing a f t e r
t h e repayment i s âedubtéa, wrircn i n d i c a t e s t h a t t h e r e c o n s t i t u t i o n r u l i n g
( a r t i c l e s 42 t o 44) does no t a pp ly t o t h e amounts co r re spo n d ing t o compensat ion .
A r t i c l e 174(2) reads : "The c o n t r i b u t i o n may be made, a t the request
o f the ACP S t a t e , e i t h e r :
- d i r e c t to the sys tem, or
- by d ed u c t i on f rom i t s t r a n s f e r r i g h t s e s t a b l i s h e d b e fo re any a p p l i c a t i o n
o f A r t i c l e 155, or
- by payment i n l o c a l c u r re n c y . In t h i s case . . . "

(see paragraph 24 ) . The sums co r respond ing t o repayments w i l l
be c r e d i t e d by o th e r ways t o the Lomé I I I Stabex fun d .

A r t i c l e 43(2) o f Lomé I I . Replenishment c la im s a l r e a d y e s t a b l i s h e d have been
n o t i f i e d to the ACP S ta tes concerned , which must pay o n e - f i f t h o f the amount
a n n u a l l y over f i v e y e a r s , a f t e r a tw o -yea r grace p e r i o d .
(a) Timing

IV . Cone l u s i o n
25. In the l i g h t o f the f o r e g o i n g , i t i s proposed t h a t the d r a f t d e c i s i o n
a t Annex V be adopted and t r a n s m i t t e d f o r f i n a l a p p ro v a l t o the
ACP-EEC Committee o f Ambassadors.

OF THE ACP-EEC COUNCIL OF MINISTERS
apportioning the balance of the funds from
the system for s ta b i l iz a t io n of export
earnings under the second ACP-EEC Convention

THE ACP-EEC COUNCIL OF MINISTERS,
Having regard to the second ACP-EEC Convention signed in Lomé on
31 October 1979, and in p a r t ic u la r A rt ic les 33, 35, 40, 41, 42, 46 and
155 thereo f,
Having regard to the th ird ACP-EEC Convention signed in Lomé on
8 December 1984, and in p a r t ic u la r A rt ic les 154, 156 and 174 thereo f,
Having regard to Decision No 13/81 of the ACP-EEC Council of Ministers
of 19 June 1981 reducing Stabex transfers for the 1980 application year,
Having regard to Council Decision 82/464/EEC of 14 July 1982 a llocating
the sum of 30 753 710 ECU for compensatory payments to s ta b i l iz e export
earnings (1981),
Having regard to Decision No 9/82 of the ACP-EEC Council of Ministers of
5 August 1982 reducing transfers under the Stabex system for the
1981 application year,
Having regard to the conclusions of the ACP-EEC Committee of Ambassadors
(Stabex: inadequacy of resources for 1981) approved on 5 August 1982,
Having regard to Decision No 2/85 of the ACP-EEC Council of Ministers of
22 February 1985 on t ra n s i t io n a l measures to apply from 1 March 1985,
Having regard to decision No 7/85 of the ACP-EEC Council of Ministers of
21 June 1985 delegating powers to the ACP-EEC Committee of Ambassadors
to deal with the balance of the fund for s ta b i l iz a t io n of export earnings,
Whereas a f te r payment of Stabex transfers for the f in a l application year
under the second ACP-EEC Convention a balance of the fund remains unspent;
Whereas the system lacked s u f f ic ie n t resources for the 1980 and 1981
application years to enable the ACP States to be compensated in f u l l for
th e ir loss of earnings and transfers had accordingly to be reduced;
Whereas Decision No 7/85 of the ACP-EEC Council of M inisters provides that
the balance of the Stabex resources should be used to pay part of the amounts
outstanding;
Whereas the said Decision also provides that replenishment claims shall
be o ffse t and that the m obilization of add itional resources shall be taken
in to account;
Whereas the treatment of the transfers fo r the 1980 and 1981 application
years should, a f te r apportionment of the balance, be id e n t ic a l;

Whereas A r t ic le 46(2) of the second ACP-EEC Convention provides that when
transfers are reduced because of an in su ffic iency of funds, the special
d i f f i c u l t i e s of the ACP States l is te d in A r t ic le 1 5 5 (3 )(a) sha ll be taken
in to account; whereas regard should be had in p a r t ic u la r to A r t ic le 155(3 )(c )
of the th ird Lomé Convention;
Whereas provision should be made for applying the p r in c ip le stated at the
second indent of A r t ic le 174 (2) of the th ird ACP-EEC Convention ;
Whereas the apportioned funds should be paid out under t ra n s fe r
agreements using the procedure la id down in the second ACP-EEC Convention;
Whereas sums to be repaid during the l i fe t im e of the th ird ACP-EEC Convention
from Stabex transfers made before that period should go towards the Stabex
a l lo c a t io n under that Convention,
HAS DECIDED AS FOLLOWS:
A rt ic le 1
The balance remaining from the system for s ta b i l i z a t io n of export earnings
under the second ACP-EEC Convention is 127 180 016 ECU.
A r t ic le 2
1. The sum referred to in A r t ic le 1 sha ll be used in accordance with th is
Decision to pay part of the amounts outstanding from the 1980 and 1981
app lica t ion years.
2. The sum outstanding represents the d ifference between ju s t i f ie d transfer
app lications not paid in f u l l , net of o f fs e t replenishment claims to a
value of 25 787 209 ECU, a to ta l of 683 303 220 ECU, and the amounts paid
in p a r t ia l settlement out of ava ilab le resources, including an add it iona l
70 753 710 ECU, a to ta l of 315 705 270 ECU.
A r t ic le 3
The sum referred to in A r t ic le 1 shall be apportioned in such a way as
to ensure that the ra t io of the reduction rate for ACP States l is te d in
A r t ic le 155 (3 )(a ) of the second Convention to the rate fo r other
ACP States is .1 :1 .3 .

A r t ic le 4
1. A rt ic les 40 to 44 ° f the second Convention shall apply to payments
of shares of the sum referred to in A r t ic le 1.
2. The obligations of an ACP State to reconstitu te the transfers paid under
Lomé I I , which have been established and n o t i f ie d to the ACP State concerned
at the date of entry in to force of the present decision, w i l l be deducted against
the rights, to p a r t ic ip a te in the d is tr ib u t io n of the amount provided fo r the f i r s t
a r t ic le ,p a k in g in to consideration the real value of each ob ligation at that date.
3. Sums to which paraghaph 2 applies sha ll -be credited to the annual instalment
fo r the f i r s t app lication year under the th ird ACP_EEC Convention.
A r t ic le 5
1. Sums repaid in respect of transfers made before the l i fe t im e of the
th ird ACP-EEC Convention which f a l l due during that period shall be
allocated in accordance with A r t ic le 154(3) of that Convention.
2. Sums repaid in respect of transfers made before the l i fe t im e of
the th ird ACP-EEC Convention, which f a l l due a f te r that period shall be
allocated in accordance with a decision to be taken by the ACP-EEC Council
of Ministers under A r t ic le 156 of that Convention.
A r t ic le 6
The ACP States, the Member States and the Community shall be bound, each
to the extent to which i t is concerned, to take the measures necessary
to implement th is Decision.
Artie le 7
This Decision shall enter into force on the day on which i t is adopted.
