STATEMENT OF FACTS
The application concerns a migrant Ivorian national, allegedly 17 years old, accommodated for about four months in the Red Cross reception Centre (Rome) and then in reception Centre for minors “Villa Spada” (Rome).
QUESTIONS tO THE PARTIES
1. Has the applicant been subjected to inhuman or degrading treatment, during his stay at the Red Cross reception Centre in Rome, in breach of Article 3 of the Convention?
2. Was the applicant deprived of his liberty, in the reception Centre for minors “Villa Spada” during the age assessment procedure, in breach of Article 5 § 1 of the Convention?
3. Has the applicant been denied the right to education, guaranteed by Article 2 of Protocol No. 1?
4. Has there been an interference with the applicant’s right to respect for his private life, within the meaning of Article 8 § 1 of the Convention? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2?
5. Did the applicant have at his disposal an effective domestic remedy for his complaint under Article 3 of the Convention, as required by Article 13 of the Convention?
