SUBJECT MATTER OF THE CASE
The application concerns the excessive length of custody proceedings between the applicant and his ex-wife P.P. In particular, in November 2011 P.P. lodged an action against the applicant requesting custody of their three children and in January 2013 the applicant lodged a counter-action. The one‑member Heraklion Court of First Instance issued decision no. 272/2016 in July 2016. Following appeals by both parties, decision no. 133/2017 of the one-member Eastern Crete Court of Appeal was issued. The proceedings were concluded by decision no. 1284/2018 of the Court of Cassation published in July 2018 and finalised on 3 September 2018, while it was possible for the applicant to receive a copy of the decision from 18 September 2018.
QUESTION TO THE PARTIES
Has there been a violation of the applicant’s right to respect for his family life, contrary to Article 8 of the Convention, having regard to the excessive length of custody proceedings between the applicant and his ex-wife P.P. (Anagnostakis and Others v. Greece, no. 46075/16, 23 September 2021)?
