Summary
1. As the Court has consistently held, a Member State may not plead provisions, practices or circumstances existing within its internal legal system in order to justify a failure to discharge its obligations under Community law.
2. The immediate and uniform application of Community law requires that the process of complying with a judgment declaring that a Member State has failed to fulfil its obligations must be initiated at once and must be completed as soon as possible (see the judgment in Case 169/87 Commission v France [1988] ECR 4093).
