Declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2005/45/EC (1) of the European Parliament and of the Council of 7 September 2005 on the mutual recognition of seafarers' certificates issued by the Member States and amending Directive 2001/25/EC and, in any event, by failing to notify the Commission thereof, the Italian Republic has failed to fulfil its obligations under Article 5 of that directive.
