The Tribunal:

Annuls the decision of the Adjudication Panel of the European Investment Bank of 18 December 2012;

Declares that there is no need to rule on the pleas seeking the annulment of the staff report for 2011 and all the connected, consequent and prior acts;
3.
Dismisses the remainder of the action;
4.
Orders the European Investment Bank to bear its own costs and pay the costs incurred by Mr De Nicola.
