The applicant claims that the court should:

declare that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with the provisions of Commission Directive 2013/2/EU of 7 February 2013 amending Annex 1 to Directive 94/62/EC of the European Parliament and of the Council on packaging and packaging waste (1) or, in any event, by failing to communicate the same to the Commission, Romania has failed to fulfil its obligations under Article 2(1) of that directive;
—
order Romania to pay the costs of the proceedings.
Pleas in law and main arguments
The time-limit for transposition of the directive into national law expired on 30 September 2013.
