SUBJECT MATTER OF THE CASE
The application concerns the enforcement of a final judgment adopted in civil proceedings, more than ten years after its adoption, in circumstances in which the legal time-limit for applying for a final judgment to be enforced was three years. It raises issues similar to those examined by the Court in the case of Dragostea Copiilor - Petrovschi - Nagornii v. Moldova, no. 25575/08, 13 September 2011.
The applicant company, who was defendant in the domestic proceedings, complains under Article 6 § 1 and Article 1 of Protocol No. 1 to the Convention that the principle of legal certainty was breached and that he lost property as a result of that breach.
QUESTION tO THE PARTIES
Was there a breach of the applicant’s rights under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 to the Convention, as a result of the upholding by the domestic courts of the request concerning the enforcement of the final judgment of 11 November 1998 (Dragostea Copiilor - Petrovschi - Nagornii v. Moldova, no. 25575/08, 13 September 2011)?
