FOURTH SECTION
Application no. 20190/12
F.Y.
against Finland
lodged on 29 March 2012
STATEMENT OF FACTS
The applicant is an Iranian national, who was born in 1984. He applied asylum in Finland, but his application was rejected. He is represented before the Court by Mr Pirkka Lappalainen, a lawyer practising in Tampere.
COMPLAINTS
The applicant complains under Article 2 of the Convention that if he is returned to Iran, he will be subjected to inhuman treatment and/or his life will be endangered.
QUESTION
In the light of the applicant’s claims and the documents which have been submitted, would he face a risk of being subjected to treatment in breach of Article 3 of the Convention if expelled to Iran? In particular, in deciding on his expulsion, did the authorities give proper consideration to the written evidence submitted by the applicant in autumn 2009 and was it taken into account in the assessment of risk in the applicant’s case?
