FIFTH SECTION
Application no. 25115/24
Paola GASPERONI
against San Marino
lodged on 29 August 2024
communicated on 18 June 2025
SUBJECT MATTER OF THE CASE
The application concerns separation and child custody/maintenance proceedings which started on 24 July 2014 and came to an end by a third instance judgment of 8 May 2024 notified on 16 May 2024, over three levels of jurisdiction.
Invoking Articles 6 § 1 and 8 of the Convention the applicant complains about the length of the proceedings.
QUESTION TO THE PARTIES
Was the length of the civil proceedings in the present case in breach of the “reasonable time” requirement of Article 6 § 1 of the Convention, and did such a duration breach the applicant’s right to private and family life under Article 8 of the Convention (see Laino v. Italy [GC], no. 33158/96, ECHR 1999‑I)?
