SUBJECT MATTER OF THE CASE
The applicant, a former senior police officer, was initially acquitted of the charges of unlawful interference with the exercise of the right to peaceful protest but then convicted on appeal.
The court of appeal refused to call witnesses Y.М.B., Y.B.A., N.G.M., P.O.P., P.Y.B., O.V.P. on whose evidence the trial court had relied in part in acquitting the applicant.
QUESTIONS TO THE PARTIES
1. Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 § 1 of the Convention?
2. In particular, was the refusal to examine, in the appeal proceedings, Y.М.B., Y.B.A., N.G.M., P.O.P., P.Y.B. and O.V.P., compatible with the requirements of Article 6 § 3 (d) of the Convention?
