SUBJECT MATTER OF THE CASE
The applicant, a former prosecutor, was dismissed from his job following several publications by his former partner in the newspaper about their conjugal life issues.
The applicant’s civil action against the newspaper and his partner was successful, but the courts dismissed his claims for pecuniary and non‑pecuniary damages.
The applicant also brought proceedings against his employer and asked for reinstatement in his position. By a final decision of 6 June 2013 the Supreme Court dismissed his claim.
QUESTIONS tO THE PARTIES
1. Did the applicant have a fair hearing in the determination of his civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, was the applicant’s right to a reasoned decision respected?
2. Has there been an interference with the applicant’s right to respect for his private life, within the meaning of Article 8 § 1 of the Convention, as a result of his dismissal from the prosecuting authorities because of his conjugal life problems? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2?
