First-instance conviction upheld by Court of Appeal without a public hearing: no violation

Manner of application of Article 6 to proceedings before courts of appeal depends on special features of the domestic proceedings viewed as a whole.
Having regard to fact that public hearing held at first instance, to role of Court of Appeal, to nature of issues submitted to it – which included no questions of fact or law which could not be adequately resolved on the basis of the case-file – and to minor character of offence, special features existed to justify absence of public hearing on appeal.
Conclusion: no violation (thirteen votes to seven).
