STATEMENT OF FACTS
THE FACTS
The first and second applicants are a couple who were born in 1964 and 1965, respectively. The third applicant is their son, born in 2000. They are Iraqi nationals who are currently in Sweden. They are represented before the Court by Mrs C. Skyfaros, a lawyer practising in Limhamn. The Swedish authorities have ordered their deportation back to Iraq.
COMPLAINTS
The applicants essentially complain under Article 3 of the Convention that, if they were deported from Sweden to Iraq, they would face a real risk of being killed by Al-Qaida members since the second applicant previously had collaborated with American companies and since the Iraqi authorities lack the possibility to protect them.
QUESTION
In the light of the applicants’ claims and the documents which have been submitted, would they face a risk of being subjected to treatment in breach of Article 3 of the Convention if the deportation order to Iraq were enforced?
