SUBJECT MATTER OF THE CASE
The application concerns the refusal to allow the applicants, two Bulgarians nationals, to inherit immovable property located in Turkey, on the ground that the criterion of reciprocity between Bulgaria and Turkey had not been met.
Relying on Article 14 of the Convention and on Article 1 of Protocol No. 1, the applicants claim that they their right to property have been breached and that the violations in question had occurred as a result of their ethnic origin.
QUESTIONs tO THE PARTIES
1. In the light of the Court’s relevant case-law (Apostolidi and Others v. Turkey, no. 45628/99, 27 March 2007, Nacaryan and Deryan v. Turkey, nos. 19558/02 and 27904/02, 8 January 2008, Fokas v. Turkey, no. 31206/02, 29 September 2009), did the applicants have “possessions” within the meaning of Article 1 of Protocol No. 1 to the Convention?
2. If so, has there been a violation of the aforementioned provision, alone or in conjunction with Article 14 of the Convention?
