FIRST SECTION
Application no. 49446/15
Stefan Karl KRISTJANSSON
against Iceland
lodged on 28 September 2015
SUBJECT MATTER OF THE CASE
The application concerns the alleged violation of the applicant’s right to a fair trial due to the imposition of a fine for contempt of court (réttarfarssekt).
QUESTIONs TO THE PARTIES
Did the Supreme Court´s judgment of 31 March 2015 confirming the District Court’s judgment of 11 February 2014, to impose a fine on the applicant for contempt of court although lowering the fine to 50,000 Icelandic krona, violate the applicant’s right to a fair trial under Article 6 § 1 and 6 § 3 of the Convention? In particular, was the applicant tried and convicted by the District Court in absentia? If so, was the Supreme Court capable of remedying on appeal the defects of the District Court’s proceedings?
