Having regard to the above application lodged on 24 March 2021,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Sotirios Kritikos, was born in 1956. He was represented by Ms X. Moysidou, a lawyer practising in Thessaloniki.
The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of his detention, as well as under Article 13 of the Convention concerning the lack of any effective remedy in domestic law in respect of inadequate conditions of detention, were communicated to the Greek Government (“the Government”).
On 2 February 2022 the Government informed the Registry that the applicant had died and asked the Court to strike the application out of the list of cases. On 8 March 2022 the applicant’s representative was sent the Government’s information and was asked to submit comments by 7 April 2022. Τhe applicant’s representative did not submit any comments, nor have any heirs or close family members of the applicant come forward to pursue the application.
THE LAW
In the light of the foregoing, the Court concludes that the applicant’s potential heirs do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
