SUBJECT MATTER OF THE CASES
The applicants are a mother with two children, and an unaccompanied minor, all of Syrian nationality. The applications concern the alleged push‑backs of the applicants from Greece back to Turkey after they crossed the borders in Evros-Edirne area in February 2020.
QUESTIONS TO THE PARTIES
1. Did the applicants cross the borders from Turkey and enter Greece on the alleged dates? Were they arrested from the Greek police or other State agents and transferred back to Turkey? The parties are invited to submit any evidence they may have in this regard.
2. Has there been a violation of Article 3 of the Convention on account of the alleged push-backs of the applicants from the Greek soil to the Turkish side of the borders which according to them, obstructed them from lodging an asylum request and a family reunification request?
3. Has there been a violation of Article 3 and/or Article 5 of the Convention on account of transfer of the applicants from Greece to Turkey and the conditions under which it allegedly took place?
4. Has there been a violation of Article 13 of the Convention taken alone and/or in conjunction with Article 3 of the Convention on account of the lack of a legal remedy in respect of the above-mentioned complaints?
