SUBJECT MATTER OF THE CASE
The applicants, Ms Özlem İlbey and Ms Eylem Aydın, are Turkish nationals, who were born in 1986 and 1981 respectively. They were detained in İzmir prison at the time of their applications to the Court. The application concerns the conviction of the applicants for membership of the PKK, an illegal armed organisation under Articles 220 § 6 and 314 of the Criminal Code and for disseminating propaganda in favour of the PKK under section 7 § 2 of the Prevention of Terrorism Act on account of their participation in a demonstration, during which they allegedly chanted slogans in favour of the PKK. The applicants rely on Articles 6, 7 and 11 of the Convention.
QUESTIONS tO THE PARTIES
1. Are the applicants currently detained on the basis of their convictions giving rise to the present applications?
2. Has there been a violation of the applicants’ right to freedom of assembly, contrary to Article 11 of the Convention, on account of their conviction under Articles 220 § 6 and 314 of the Criminal Code and section 7 § 2 of the Prevention of Terrorism Act?
