QUESTION
Regard being had to the Court’s request of 20 April 2015 to provide additional documents from the criminal case-file concerning prosecution of the military authorities implicated in the Sknyliv aviation show accident and to comment on the independence of the experts engaged in the aviation expert assessment of 27 April 2004, does the Government’s failure to comply with the said request for over six months amount to Ukraine’s failure to furnish all necessary facilities for the examination of the above application, as required by Article 38 of the Convention?
