SUBJECT MATTER OF THE CASE
The application concerns discrimination in exercising family life based on the applicant’s illness (HIV-positive). The main issue is whether he can still claim to be a victim of a breach of these provisions after that breach was established by the domestic courts, which awarded an allegedly small amount of compensation (equivalent to EUR 198).
QUESTION tO THE PARTIES
Has there been a breach of Articles 8 and 14 of the Convention in the present case? In particular, in view of the judgments and award made by the domestic courts, can the applicant still claim to be a victim of a breach of these provision (Kiyutin v. Russia, no. 2700/10, §§ 39-74, ECHR 2011)?
