SUBJECT MATTER OF THE CASE
The application concerns the suspension of duties of the applicant, an anaesthesiologist working in a public hospital, for refusal to comply with the obligatory vaccination for healthcare workers against Covid-19. The applicant was suspended by a decision of the head of the hospital and lodged an application for annulment against that decision with the Thessaloniki Administrative Court of Appeal. His application for annulment was dismissed by decision no. 590/2023 of the Thessaloniki Administrative Court of Appeal, delivered on 27 December 2023 and finalised on 30 January 2024.
QUESTIONS TO THE PARTIES
1. Has there been a violation of Article 8 of the Convention because of the obligation imposed on the applicant, as a healthcare worker, to be vaccinated against Covid-19 in accordance with Article 206 of Law no. 4820/2021?
2. Has there been a violation of Article 1 of Protocol No. 1 to the Convention because of the suspension of duties imposed on the applicant for his refusal to get vaccinated against Covid-19, given that he received no salary during the period of suspension and that he was not allowed to seek another employment?
