Opinion of the Advocate-General

Mr Advocate General Lenz delivered his Opinion on 2 July 1991.(*) He proposed that the Court:
hold that the Commission' s assessment is well founded and declare that the Grand Duchy of Luxembourg has failed to fulfil its obligations under the EEC Treaty by failing to introduce and communicate to the Commission, within the prescribed period, the programmes and the laws, regulations and administrative measures needed to comply with the obligations imposed on it by Directive 85/339/EEC on containers of liquids for human consumption. As the Commission also asks, the defendant should be ordered to pay the costs as it has been unsuccessful.
