Applicant's complaint based on the fact that he had not the opportunity to present oral argument on the merits, notwithstanding President's alleged indication that there would be a further hearing. Dispute concerning exact course of proceedings in the Court of Appeal, on which the European Court had to decide on the basis of the available evidence. Insufficient prima facie evidence of accuracy of applicant's version of events.
Conclusion: no violation (six votes to three).
