SUBJECT MATTER OF THE CASE
The applicant complains about his ineligibility to stand for election to the House of Peoples and the Presidency of Bosnia and Herzegovina because he does not declare affiliation with any “constituent people”. He relies on Article 14 of the Convention, Article 3 of Protocol No. 1 and Article 1 of Protocol No. 12.
QUESTIONS TO THE PARTIES
1. Can the applicant claim to be a “victim” of the alleged violations of his rights within the meaning of Article 34 of the Convention (see Kovačević v. Bosnia and Herzegovina [GC], no. 43651/22, §§ 166-80, 25 June 2025, with further references)? Notably, does the applicant actively participate in the political life of the country (see Sejdić and Finci v. Bosnia and Herzegovina [GC], nos. 27996/06 and 34836/06, § 29, ECHR-2009, and Zornić v. Bosnia and Herzegovina, no. 3681/06, § 17, 15 July 2014)?
2. Has there been a breach of the applicant’s rights under Article 14 of the Convention, Article 3 of Protocol No. 1 to the Convention and/or Article 1 of Protocol No. 12 to the Convention, as a result of his ineligibility to stand for election to the House of Peoples and/or the Presidency of Bosnia and Herzegovina (see Sejdić and Finci, cited above, and Zornić, cited above)?
