THE COUNCIL OF THE EUROPEAN COMMUNITIES, HAS ADOPTED THIS REGULATION:
Having regard to the Treaty establishing the European
Economic Community,
Having regard to the proposal from the Commission,
Having regard to the opinion of the European Par-
liament,
Having regard to the opinion of the Economic and
Social Committee,
Whereas production costs differ appreciably in certain
regions of the Community, for the production of lamb in
the various areas making up this region; whereas the
seasonal variation in these production costs does not
correspond to the seasonal variation in market prices in
that region; whereas provision should be made, for this
region as well, for modulation of the premium for the
producers of sheepmeat referred to in Article 5 of
Council Regulation (EEC) No 1837/80 (*), as last
amended by Regulation (EEC) No . . . ;
Whereas this modulation should, for each beneficiary,
take account:
— of the difference each week between the seasonally-
adjusted price referred to in Article 3 (3) of Regu-
lation (EEC) No 1837/80 and the market price
recorded for each region in accordance with the
provisions of Article 4 of the same Regulation,
— of seasonal changes in lamb sales,

Article 1
The following paragraph 3 a is added to Article 5 of
Regulation (EEC) No 1837/80:
'3 . (a) Insofar as is necessary to offset major
seasonal variations in the costs of producing
sheepmeat, it may be decided, in accordance with the
procedure provided for in Article 26, in the regions
where the seasonal variation in production costs
corresponds to seasonally adjusted basic prices, to
effect a seasonal modulation of the premium payable
per ewe. This modulation must be calculated in such
a way, for each beneficiary:
— that it reflects the difference between the
seasonally-adjusted basic price and the market
price, referred to in Article 4, representative for
each Member State concerned,
— it allows for seasonal changes in sales of lambs.
However, total expenditure for each marketing year
under this provision may not exceed such expenditure
as is entailed by the application of paragraph 3.
Also, only 70 % of the premium payable per ewe
may be modulated; however, where the provisions of
paragraph 4 apply, only the amount corresponding to
the balance of the premium paid in the less-favoured
agricultural areas may be modulated.'
Article 2
This Regulation shall enter into force on the third day
following its publication in the Official Journal of the
European Communities.
It shall apply for the first time to the premiums granted
for the 1987 marketing year.
This Regulation shall be binding in its entirety and
directly applicable in all Member States.
