Proposal for a Council Regulation amending the Regulation on the common organization of the
market in wine

THE COUNCIL OF THE EUROPEAN COMMUNITIES, HAS ADOPTED THIS REGULATION:
Having regard to the Treaty establishing the European
Economic Community, and in particular Article 43
thereof,
Having regard to the proposal from the Commission,
Having regard to the opinion of the European Par-
liament,
Having regard to the opinion of the Economic and
Social Committee,
Whereas, on account of the accession of Spain,
alterations should be made to the demarcation of the
wine-growing zones provided for in Article 18 of Regu-
lation (EEC) No /86 ;
Whereas, in view in particular of the climatic features,
provision should be made by the end of the 1989/90
wine year at the latest, for a new demarcation of wine-
growing zones for the Community as a whole, using as a
basis a report to be drawn up by the Commission;
Whereas Spanish legislation prior to accession provided,
for virtually all its wine-growing area, for a minimum
natural alcoholic strength by volume of 9 °/o vol,
corresponding to that of wine-growing zone C III;
whereas that situation should be confirmed until the end.
of the 1989/90 wine year by including the major part of
Spain's wine-growing area in wine-growing zone
C H I b ) ;
Whereas a certain number of the oenological pratices
and processes authorized for the Community as a whole
are never used, rarely used or used only under much
more restricted conditions than originally foreseen in one
or more Member States; whereas, in order to encourage
the production of wines of a natural character derived
from the intrinsic properties of the raw material used, the
substances which may be added to wine during its
preparation or storage should be reduced to the strict
minimum necessary; whereas the Member States should,
therefore, be authorized to ban or at least restrict the use
of certain oenological practices or processes in the
production of wine on their territory, provided that such
measures do not prejudice consumer protection in the
Member States or the normal pattern of intra-
Community trade,
Article 1
Regulation (EEC) No /86 is hereby amended as
follows:
1. The following subparagraph is added to Article
18(3):
'The Commission shall, before the end of the
1989/90 wine year, submit to the Council a report on
the demarcation of wine-growing zones in the
Community. The Council, acting by a qualified
majority on a proposal from the Commission, shall
decide on the demarcation of the wine-growing zones
for the Community as a whole, such provisions
applying from the 1990/91 wine year.'
2. The first subparagraph of Article 15 (2) is replaced by
the following:
'2. By way of derogation from paragraph 1,
Member States may, in respect of wines and products
intended for winemaking obtained from grapes
harvested on their territory,
— prohibit the use of the oenological practices and
processes referred to in Annex VI, or
— lay down stricter conditions on the use of the
oenological pratices and processes referred to in
the said Annex.'
3. Annex IV is hereby amended as follows:
(a) point 3 is replaced by the following:
'3. Wine-growing zone C I a) comprises the area
under vines:
(a) in France:
— in the following departments:
Allier, Alpes-de-Haute-Provence,
Hautes-Alpes, Alpes-Maritimes,
Ariege, Aveyron, Cantal, Charente,
Charente-Maritime, Correze, Cote-
d'Or, Dordogne, Haute-Garonne,
Gers, Gironde, Isere, Landes, Loire,
Haute-Loire, Lot, Lot-et-Garonne,
Lozere, Nievre (except for the the
arrondissement of Cosne-sur-Loire),
Puy-de-Dome, Pyrenees-Atlantiques,
Hautes-Pyrenees, Rhone, Saone-et-
Loire, Tarn, Tarn-et-Garonne, Haute-
Vienne, Yonne;

— in the arrondissement of Valence and
Die in the department of Drome
(except for the cantons of Dieulefit,
Loriol, Marsanne and Montelimar);
— in the department of Ardeche, the
arrondissement of Tournon and the
cantons of Antraigues, Buzet,
Coucouron, Montpezat-sous-Bauzon,
Privas, Saint-Etienne-de-Lugdards,
Saint- Pierreville, Valgorge and La
Voulte-sur-Rhone;
(b) in Spain:
— in the following provinces:
— Asturias, Cantabria, Guipuzcoa, La
Coruna, Pontevedra and Vizcaya;
— in the province of Tarragona:
the defined wine-growing district of
Conca de Barbera;
— in the provinces of Barcelona and
Tarragona:
the defined wine-growing district of
Alto Penedes;
(b) the following is added to point 7:
'(d) in Spain, the areas under vines not listed in
point 3 (b).'
(c) the following is added to point 8:
'and, in respect of Spain, those in force on 1
March 1986.'
Article 2
This Regulation shall enter into force on 1 September
1986.
This Regulation shall be binding in its entirety and
directly applicable in all Member States.
