The application concerns criminal conviction on the charges of unlawful distribution of pornography (the applicant posted a photograph of a penis on a page in a social network). The applicant complains that the national law at the time did not define clearly the relevant offence.
QUESTION tO THE PARTIES
Was there a sufficiently clear legal basis for the applicant’s conviction, as required by Article 7 § 1 of the Convention? In particular, did the national law at the material time define clearly the criminal offence of unlawful distribution of pornography (Article 242 of the Criminal Code of the Russian Federation)?
