SUBJECT MATTER OF THE CASE
The application concerns the alleged breach of Article 6 §§ 1 and 3 (a) and (b) of the Convention in the criminal proceedings against the applicant. As a former mayor, he was charged with abuse of office and was acquitted by the first-instance court. Although the prosecutor maintained that charge on appeal and the appellate court upheld the first-instance court’s findings in that respect, it nevertheless quashed the judgment and delivered a new one, reclassifying the offence as negligence in office on the basis of the same facts and finding the applicant guilty. The cassation court dismissed the applicant’s cassation appeal, finding no issues under the domestic law or Article 6 of the Convention.
QUESTION TO THE PARTIES
Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 §§ 1 and 3 (a) and (b) of the Convention, regard being had, in particular, to the reclassification of the charge against him by the appellate court?
