SUBJECT MATTER OF THE CASE
The application concerns criminal proceedings in a private sector corruption case, involving 45,000 audio files, 34,000 text messages and 14 million email and document files secured as evidence by the investigating authorities.
QUESTIONS tO THE PARTIES
1. Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 § 1 of the Convention? In particular, was the principle of equality of arms respected as regards the possibility to examine the case files?
2. Was the applicant afforded adequate time and facilities to prepare his defence, as required by Article 6 § 3 (b) of the Convention? In particular, was there enough time and facilities for the defence to examine adequately audio files and text messages as well as email and document files?
