Claim for just satisfaction by an applicant whom the Court had held to be the victim of a breach of Article 14 of the Convention

Court took note of rehearing proceedings which, following its principal judgment, had taken place in the Federal Insurance Court and had culminated in applicant's being awarded a full invalidity pension — the passing of time (about eight years) had not been taken into account by that court.
It was justified under Convention for Court to award some interest for the period in question but it did not, however, agree with method of calculation proposed by applicant.
Conclusion: respondent State to pay a specified sum to the applicant in respect of pecuniary damage (seven votes to two).
