QUESTIONS TO THE PARTIES
Has the applicant complied with admissibility criteria provided for by Article 35 §§ 2 (b) and § 3 (a) of the Convention? In particular:
- Is the applicant’s application lodged with the Court substantially the same as a matter that has already been submitted to the United Nations Human Rights Committee (“HRC”) (see Smirnova v. Russia (dec.) nos. 46133/99 and 48183/99, 3 October 2002, and Vojnovic v. Croatia (dec.), no. 4819/10, §§ 26-32, 26 June 2012)?
- Did the applicant abuse his right of individual petition by not informing the Court of the application to the HRC (see, mutatis mutandis, Gross v. Switzerland [GC], no. 67810/10, §§ 27-37, ECHR 2014; Gevorgyan and Others v. Armenia (dec.), no. 66535/10, §§ 31-39, 14 January 2020; and Safaryan v. Armenia (dec.), no. 16346/10, §§ 26-31, 14 January 2020)?
