withtheSolemnDeclarationofStutgartof19June1983,
RESOLVED toimplementthisEuropeanUnion onthebasis,firstly,oftheCommunitiesoperatingin
accordancewiththeirownrulesand,secondly,ofEuropeanCooperationamongtheSignatoryStatesinthe
sphereofforeignpolicyandtoinvestthisunionwiththenecessarymeansofaction,
DETERMINEDtoworktogethertopromotedemocracyonthebasisofthefundamentalrightsrecognizedin
theconstitutionsandlawsoftheMemberStates,intheConventionfortheProtectionofHumanRightsand
FundamentalFreedomsandtheEuropeanSocialCharter,notablyfreedom,equalityandsocialjustice,
CONVINCEDthattheEuropeanidea,theresultsachievedinthefieldsofeconomicintegrationandpolitical
cooperation,andtheneedfornewdevelopmentscorespondtothewishesofthedemocracticpeoplesof
Europe,forwhom theEuropeanParliament,electedbyuniversalsufrage,isanindispensablemeans of
expression,
AWAREoftheresponsibilityincumbentuponEuropetoaimatspeakingeverincreasinglywithonevoiceand
toactwith consistencyandsolidarityinordermore efectivelytoprotectitscommoninterestsand
independence,inparticulartodisplaytheprinciplesofdemocracyandcompliancewiththelawandwith
humanrightstowhich theyareatached,sothattogethertheymay make theirowncontributiontothe
preservationofinternationalpeaceandsecurityinaccordancewiththeundertakingenteredintobythemwithin
theframeworkoftheUnitedNationsCharter,
DETERMINEDtoimprovetheeconomicandsocialsituationbyextendingcommonpoliciesandpursuingnew
objectives,andtoensureasmootherfunctioningoftheCommunitiesbyenablingtheInstitutionstoexercise
theirpowersunderconditionsmostinkeepingwithCommunityinterests,
WHEREAS attheirConferenceinParisfrom19to21October1972theHeadsofStateorofGovernment
approvedtheobjectiveoftheprogressiverealizationofEconomicandMonetary Union,
HAVINGREGARDtotheAnnextotheconclusionsofthePresidencyoftheEuropeanCouncilinBremenon6
and7July1978andtheresolutionoftheEuropeanCouncil inBrusselson5December 1978onthe
introductionoftheEuropeanMonetary System(EMS)andrelatedquestions,andnotingthatinaccordance

Article 1
The European Communities and European Political
Co-operationshalhaveastheirobjectivetocontribute
togethertomaking concreteprogresstowardsEuropean
unity.
The European Communities shal befoundedonthe
Treaties establishing theEuropean Coal und Steel
Community,theEuropean Economic Community,the
European Atomic Energy Community and on the
subsequentTreatiesandActsmodifyingorsupplementing
them.
PoliticalCo-operationshalbegovernedbyTitleII. The
provisionsofthatTitleshalconfirmandsupplementthe
proceduresagreedinthereportsofLuxembourg(1970),
Copenhagen (1973), London (1981), the Solemn
DeclarationonEuropeanUnion (1983)andthepractices
gradualyestablishedamongtheMemberStates.
Article 2
TheEuropeanCouncilshalbringtogethertheHeadsof
StateorofGovernmentoftheMember Statesandthe
Article 3
1. The institutionsof theEuropean Communities,
henceforth designated as referedtohereafter, shal
exercisetheirpowersandjurisdictionundertheconditions
and forthepurposesprovided forby theTreaties
establishingtheCommunities andby thesubsequent
TreatiesandActsmodifyingorsupplementingthemandby
theprovisionsofTitleI.
2. TheinstitutionsandbodiesresponsibleforEuropean
Political Co-operation shal exercisetheirpowersand
jurisdictionundertheconditionsandforthepurposeslaid
downinTitleIIandinthedocumentsreferedtointhe
thirdparagraphofArticle1.

Article 4
The ECSC Treaty issupplementedby thefolowing
provisions:
'Article32d
1. AttherequestoftheCourtofJusticeandafter
consulting the Commission and the European
Parliament,theCouncil may, actingunanimously,
atachtotheCourtofJusticeacourtwithjurisdiction
tohearanddetermineatfirstinstance,subjecttoa
rightofappealtotheCourtofJusticeonpointsoflaw
onlyandinaccordancewiththeconditionslaiddown
bytheStatute,certainclassesofactionorproceeding
broughtbynaturalorlegalpersons.Thatcourtshal

paragraph1,shaldeterminethecompositionofthat
court and adopt thenecessary adjustments and

years.Themembershipshalbepartialyrenewedevery

threeyears. Retiring members shal beeligiblefor
reappointment.
4. Thatcourtshalestablishitsrulesofprocedurein
agreementwiththeCourtofJustice.Thoserulesshal

Article 5
'Aftertheendofthesecondstage,however,theCouncil
shal,actingbyaqualifiedmajorityonaproposalfrom
theCommissionandinco-operationwiththeEuropean
Parliament,issuedirectivesfortheco-ordinationof
suchprovisionsas,ineachMemberState,areamater
forregulationoradministrativeaction.'.
6. InArticle57(1)oftheEECTreatytheterms'andafter
consultingtheAssembly'shal bereplacedby'andin
co-operationwiththeEuropeanParliament'.
7. InArticle57(2)oftheEECTreaty,thethirdsentence
shalbereplacedbythefolowing:
'InothercasestheCouncilshal actbyaqualified
majority, in co-operation with the European
Parliament.'.
Article 45oftheECSCTreatyissupplementedbythe
folowingparagraph:
TheCouncilmay,actingunanimouslyattherequestof
the Court of Justice and after consulting the
CommissionandtheEuropeanParliament,amendthe
provisionsofTitleIIoftheStatute.'.
CHAPTERI
PROVISIONSAMENDING THE TREATY ESTABLISHING
THEEUROPEANECONOMICCOMMUNITY
Article 7
Article 149oftheEECTreatyshalbereplacedbythe
folowingprovisions:
'Article149
1. Where,inpursuanceofthisTreaty,theCouncil
actsonaproposalfromtheCommission,unanimity
shalberequiredforanactconstitutinganamendment
tothatproposal.
2. Where,inpursuanceofthisTreaty,theCouncil
actsinco-operationwiththeEuropeanParliament,the
folowingprocedureshalapply:
(a)TheCouncil,actingbyaqualifiedmajorityunder
theconditionsofparagraph1,onaproposalfrom
theCommissionandafterobtainingtheOpinionof
theEuropeanParliament,shaladoptacommon
position.
(b)The Council's common position shal be
communicatedtotheEuropeanParliament. The
Council andtheCommission shal informthe
EuropeanParliamentfulyofthereasonswhichled
theCounciltoadoptitscommonpositionandalso
oftheCommission'sposition.
If,withinthreemonthsofsuchcommunication,the
European Parliament approves this common
positionorhasnottakenadecisionwithinthat
period,theCouncilshaldefinitivelyadopttheactin
questioninaccordancewiththecommonposition.
(c)TheEuropeanParliamentmaywithintheperiodof
threemonthsreferedtoinpoint(b),byanabsolute
majority of itscomponent members, propose
amendmentstotheCouncil'scommonposition.
TheEuropeanParliamentmay also,bythesame
majority,rejecttheCouncil'scommonposition.
Theresultoftheproceedingsshalbetransmitedto
theCouncilandtheCommission.
SectionI
InstitutionalProvisions
Article 6
1. A co-operationprocedureshalbeintroducedwhich
shalapplytoactsbasedonArticles7,49,54(2),56(2),
secondsentence,57with theexceptionofthesecond
sentenceofparagraph2thereof,100a,100b,118a,130e
and130q(2)oftheEECTreaty.
2. InArticle7,secondparagraphoftheEECTreatythe
terms'afterconsultingtheAssembly'shalbereplacedby
'inco-operationwiththeEuropeanParliament'.
3. InArticle49oftheEECTreatytheterms'theCouncil
shal,actingonaproposalfromtheCommissionandafter
consultingtheEconomicandSocialCommitee',shalbe
replacedby'theCouncil shal, actingby aqualified
majority on a proposal fromtheCommission, in
co-operationwith theEuropean Parliamentandafter
consultingtheEconomicandSocialCommitee'.
4. InArticle 54(2)oftheEECTreatytheterms'the
Councilshal,onaproposalfromtheCommissionand
afterconsultingtheEconomicandSocialCommiteeand
theAssembly',shal bereplacedby'theCouncil shal,
actingonaproposalfromtheCommission,incooperation
with theEuropeanParliamentandafterconsultingthe
EconomicandSocialCommitee'.
5. InArticle56(2)oftheEECTreatythesecondsentence
isreplacedbythefolowing:

Article 10
Article145oftheEECTreatyshalbesupplementedbythe
folowingprovision:
'— conferontheCommission,intheactswhichthe
Counciladopts,powersfortheimplementationof
theruleswhich theCouncil laysdown. The
Council may imposecertain requirementsin
respectoftheexerciseofthesepowers. The
Council may alsoreservetheright,inspecific
cases,toexercisedirectlyimplementingpowers
itself.Theproceduresreferedtoabovemustbe
consonantwith principlesandrulestobelaid
down in advance by the Council, acting
unanimouslyonaproposalfromtheCommission
andafterobtainingtheOpinionoftheEuropean
Parliament.'.
IftheEuropean Parliament has rejectedthe
Council'scommonposition,unanimityshal be
requiredfortheCouncil toacton a second
reading.
(d)TheCommission shal,within aperiodofone
month,re-examinetheproposalonthebasisof
whichtheCounciladopteditscommonposition,by
takingintoaccounttheamendmentsproposedby
theEuropeanParliament.
TheCommissionshalforwardtotheCouncil,at
thesametimeasitsre-examinedproposal,the
amendmentsoftheEuropeanParliamentwhichit
hasnotaccepted,andshalexpressitsopinionon
them.TheCouncilmay adopttheseamendments
unanimously.
(e)TheCouncil,actingbyaqualifiedmajority,shal
adopt the proposal as re-examined by the
Commission.
Unanimity shal berequiredfortheCouncil to
amend theproposal as re-examined by the
Commission.
(f) Inthecasesreferedtoinpoints(c),(d)and(e),the
Councilshalberequiredtoactwithinaperiodof
threemonths.Ifnodecisionistakenwithinthis
period,theCommissionproposalshalbedeemed
nottohavebeenadopted.
(g)Theperiodsreferedtoinpoints(b)and(f)maybe
extendedbyamaximumofonemonthbycommon
accordbetweentheCouncil andtheEuropean
Parliament.
AslongastheCouncilhasnotacted,theCommission
mayalteritsproposalatanytimeduringtheprocedures
mentionedinparagraphs1and2.'.
Article 11
TheEECTreatyshalbesupplementedbythefolowing
provisions:
'Article168a
1. AttherequestoftheCourtofJusticeandafter
consulting the Commission and the European
Parliament,theCouncil may, actingunanimously,
atachtotheCourtofJusticeacourtwithjurisdiction
tohearanddetermineatfirstinstance,subjecttoa
rightofappealtotheCourtofJusticeonpointsoflaw
onlyandinaccordancewiththeconditionslaiddown
bytheStatute,certainclassesofactionorproceeding
broughtbynaturalorlegalpersons.Thatcourtshal
notbe competenttohearanddetermineactions

3. Themembersofthatcourtshalbechosenfrom

Article 8
ThefirstparagraphofArticle237oftheEECTreatyshal
bereplacedbythefolowingprovision:
'AnyEuropeanStatemayapplytobecomeamemberof
theCommunity.Itshaladdressitsapplicationtothe
Council,whichshalactunanimouslyafterconsulting
theCommissionandafterreceivingtheassentofthe
EuropeanParliamentwhich shalactbyanabsolute
majorityofitscomponentmembers.'.
Article 9
ThesecondparagraphofArticle238oftheEECTreaty
shalbereplacedbythefolowingprovision:
'TheseagreementsshalbeconcludedbytheCouncil,
actingunanimouslyandafterreceivingtheassentofthe
EuropeanParliamentwhich shalactbyanabsolute
majorityofitscomponentmembers.'.

Article 12
Asecondparagraphwordedasfolowsshalbeinsertedin
Article188oftheEECTreaty:
'TheCouncilmay,actingunanimouslyattherequestof
theCourt of Justice and after consulting the
CommissionandtheEuropeanParliament,amendthe
provisionsofTitleIIoftheStatute.'.
'Article8c
When drawing up itsproposalswith aview to
achievingtheobjectivessetoutinArticle 8a,the
Commissionshaltakeintoaccounttheextentofthe
efortthatcertaineconomiesshowingdiferencesin
developmentwil havetosustainduringtheperiodof
establishmentoftheinternalmarketanditmaypropose
appropriateprovisions.
Iftheseprovisionstaketheformofderogations,they
mustbeofatemporarynatureandmustcausetheleast
possibledisturbancetothefunctioningofthecommon
market.'.

Provisionsrelatingtothefoundationsandthepolicyofthe

Sub-sectionI— Internalmarket
Article 13
TheEECTreatyshalbesupplementedbythefolowing
provisions:
'Article8a
TheCommunityshaladoptmeasureswiththeaimof
progressivelyestablishingtheinternalmarket overa
periodexpiringon31December1992,inaccordance
withtheprovisionsofthisArticleandofArticles8b,
8c,28,57(2),59,70(1),84,99,100aand100band
without prejudicetotheotherprovisionsofthis
Treaty.
Theinternalmarket shalcompriseanareawithout
internalfrontiersinwhichthefreemovementofgoods,
persons,servicesandcapitalisensuredinaccordance
withtheprovisionsofthisTreaty.'.
Article 16
1. Article28oftheEECTreatyshalbereplacedbythe
folowingprovisions:
'Article28
Anyautonomousalterationorsuspensionofdutiesin
thecommoncustomstarifshal bedecidedbythe
Councilactingbyaqualifiedmajorityonaproposal
fromtheCommission.'.
2. InArticle 57(2) oftheEEC Treaty,thesecond
sentenceshalbereplacedbythefolowing:
'Unanimity shal be required for directives the
implementationofwhich involvesinatleastone
MemberStateamendmentoftheexistingprincipleslaid
downbylawgoverningtheprofessionswithrespectto
trainingandconditionsofaccessfornaturalpersons.'.
3. InthesecondparagraphofArticle 59oftheEEC
Treaty,'unanimously'shalbereplacedby'byaqualified
majority'.
4. InArticle 70(1) oftheEECTreaty,thelasttwo
sentencesshalbereplacedbythefolowing:
'ForthispurposetheCouncil shal issuedirectives,
actingbyaqualifiedmajority.Itshalendeavourto
atainthehighestpossibledegreeofliberalization.
Unanimity shal be requiredformeasures which
constituteastepbackasregardstheliberalizationof
capitalmovements.'.
5. InArticle 84(2) oftheEEC Treaty, theterm
'unanimously'shal be replacedby 'by a qualified
majority'.
6. Article84(2)oftheEECTreatyshalbesupplemented
bythefolowingparagraph:

Article 14
TheEECTreatyshalbesupplementedbythefolowing
provisions:

TheCommissionshal reporttotheCouncilbefore
31December1988andagainbefore31December1990
ontheprogressmade towardsachievingtheinternal
marketwithinthetimelimitfixedinArticle8a.
The Council,actingbyaqualifiedmajority ona

guidelinesandconditionsnecessarytoensurebalanced

harmonizationoflegislationconcerningturnovertaxes,
excisedutiesandotherformsofindirecttaxationtothe
extentthatsuchharmonizationisnecessarytoensure
theestablishmentandthefunctioningoftheinternal
marketwithinthetimelimitlaiddowninArticle8a.'. Article 19
TheEECTreatyshalbesupplementedbythefolowing
provisions:
'Article100b
1. During1992,theCommissionshal,togetherwith
eachMember State,drawupaninventoryofnational
laws,regulationsandadministrativeprovisionswhich
fal underArticle 100aandwhich havenotbeen
harmonizedpursuanttothatArticle.
TheCouncil,actinginaccordancewiththeprovisions
ofArticle100a,maydecidethattheprovisionsinforce
inaMember State must be recognizedasbeing
equivalenttothoseappliedbyanotherMemberState.
2. TheprovisionsofArticle100a(4)shalapplyby
analogy.
3. The Commission shal drawuptheinventory
referedtointhefirstsubparagraphofparagraph1and
shal submitappropriateproposalsingoodtimeto
alowtheCounciltoactbeforetheendof1992.'.
Article 18
TheEECTreatyshalbesupplementedbythefolowing
provisions:
'Article100a
1. BywayofderogationfromArticle100andsave
whereotherwiseprovidedinthisTreaty,thefolowing
provisionsshal applyfortheachievementofthe
objectivessetoutinArticle 8a. TheCouncil shal,
actingbyaqualifiedmajorityonaproposalfromthe
Commission in co-operation with the European
ParliamentandafterconsultingtheEconomic and
Social Commitee, adopt the measures for the
approximationoftheprovisionslaiddownbylaw,
regulationoradministrativeactioninMember States
which haveastheirobjecttheestablishmentand
functioningoftheinternalmarket.
2. Paragraph1shalnotapplytofiscalprovisions,to
thoserelatingtothefreemovementofpersonsnorto
thoserelatingtotherightsandinterestsofemployed
persons.
3. TheCommission,initsproposalsenvisagedin
paragraph1 concerninghealth,safety,environmental
protectionandconsumerprotection,wil takeasabase
ahighlevelofprotection.
4. If,aftertheadoptionofaharmonizationmeasure
bytheCouncil actingby aqualifiedmajority, aMember Statedeemsitnecessarytoapplynational
provisionsongroundsofmajorneedsreferedtoinArticle36,orrelatingtoprotectionoftheenvironment
or theworking environment, itshal notify the
Commissionoftheseprovisions.
TheCommissionshalconfirmtheprovisionsinvolved
afterhavingverifiedthattheyarenotameans of
arbitrarydiscriminationoradisguisedrestrictionon

theGovernmentsoftheMemberStatesforatermofsix
years.Themembershipshalbepartialyrenewedevery
threeyears. Retiring members shal beeligiblefor
reappointment.
4. Thatcourtshalestablishitsrulesofprocedurein
agreementwiththeCourtofJustice.Thoserulesshal

possiblethroughco-ordination,theconvergenceof

action.
3. (a)TheMinistersforForeignAfairsandamemberof
theCommissionshalmeetatleastfourtimesa
yearwithintheframeworkofEuropeanPolitical
Co-operation.Theymayalsodiscussforeignpolicy
maters within the framework of Political
Co-operationontheoccasionofmeetingsofthe
CounciloftheEuropeanCommunities.
(b)TheCommissionshalbefulyassociatedwiththe
proceedingsofPoliticalCo-operation.
(c)Inordertoensuretheswiftadoptionofcommon
positionsandtheimplementationofjointaction,
theHigh Contracting Parties shal,asfaras
possible,refrainfromimpedingtheformationofa
consensusandthejointactionwhichthiscould

4. TheHigh ContractingPartiesshalensurethatthe
European Parliament is closely associated with
EuropeanPoliticalCo-operation. Tothatendthe
Presidency shal regularlyinformtheEuropean
Parliamentoftheforeignpolicyissueswhicharebeing
examined within the framework of Political
Co-operationandshalensurethattheviewsofthe
European Parliament are duly taken into
consideration.
(b)Consultations shal takeplacebeforetheHigh
ContractingPartiesdecideontheirfinalposition.
(c)Inadoptingitspositionsandinitsnational
measureseachHighContractingPartyshaltake
fulaccountofthepositionsoftheotherpartners
andshalgivedueconsiderationtothedesirability
ofadoptingandimplementingcommonEuropean
positions.
Inordertoincreasetheircapacityforjointaction
intheforeignpolicyfield,theHighContracting
Partiesshalensurethatcommonprinciplesand
objectivesaregradualydevelopedanddefined.
The determinationofcommonpositionsshal
constituteapointofreferenceforthepoliciesof
theHighContractingParties.
(d)TheHighContractingPartiesshalendeavourto
avoidanyactionorpositionwhichimpairstheir
efectivenessasacohesiveforceininternational
relationsorwithininternationalorganizations.
5. TheexternalpoliciesoftheEuropeanCommunityand
thepoliciesagreedinEuropeanPoliticalCo-operation
mustbeconsistent.
ThePresidencyandtheCommission,eachwithinits
own sphere of competence, shal have special
responsibilityforensuringthatsuchconsistencyis
soughtandmaintained.
6. (a)TheHighContractingPartiesconsiderthatcloser
co-operationonquestionsofEuropeansecurity
would contributeinanessentialway tothe
developmentofaEuropeanidentityinexternal

policymaters.Theyarereadytoco-ordinatetheir
positions more closely on thepolitical and

worktothatendbothatnationalleveland,where
appropriate, within the framework of the
competentinstitutionsandbodies.
(c)Nothing in this Title shal impede closer
co-operationinthefieldofsecuritybetweencertain
of theHigh Contracting Parties within the
frameworkoftheWesternEuropeanUnionorthe
AtlanticAliance.
(b)ThePresidencyshalberesponsibleforinitiating
actionandcoordinatingandrepresentingthe
positionsoftheMember Statesinrelationswith
thirdcountriesinrespectofEuropeanPolitical
Co-operationactivities.Itshalalsoberesponsible
forthemanagementofPoliticalCo-operationand
inparticularfordrawingupthetimetableof
meetings and forconvening and organizing
meetings.
(c)ThePoliticalDirectorsshalmeetregularlyinthe
PoliticalCommiteeinordertogivethenecessary
impetus,maintain thecontinuityofEuropean
Political Co-operation andprepare Ministers'
discussions.
(d)The Political Commitee or, ifnecessary, a
ministerialmeetingshalconvenewithin48hours
.attherequestofatleastthreeMemberStates.
(e)TheEuropeanCorespondents'Group shal be
responsible,underthedirectionofthePolitical
