Having regard to the above application lodged on 16 August 2023,
Having regard to the decision to grant the applicant anonymity, in accordance with Rule 47 § 4 of the Rules of the Court,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, S.M.A., is a Surinamese national, who was born in 2000, and lives in Paramaribo.
The applicant was represented by Ms N. Swart, a lawyer practising in Groningen.
The applicant’s complaint under Article 8 of the Convention, concerning the refusal to grant him family reunification to join his mother in the Netherlands, were communicated to the Government of the Kingdom of the Netherlands (“the Government”).
Subsequently, the parties informed the Court that they had agreed to settle the matter at the domestic level. The settlement under which the applicant agreed to have her application struck out of the Court’s list of cases is subject to an undertaking by the Government to grant the applicant a provisional entry approval and subsequent residence permit for the purpose of family reunification with his mother in the Netherlands, provided that the applicant meets the formal requirements thereto. On 21 May 2025 the applicant was granted a provisional entry approval. Upon arrival, in the Netherlands, he will receive a residence permit.
THE LAW
In view of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article 37 § 1 in fine.
Accordingly, the application should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
