DECISION

Kifayat ISMAYILOVA
against Azerbaijan
The European Court of Human Rights (First Section), sitting on 27 June 2024 as a Committee composed of:
Péter Paczolay, President,
Gilberto Felici,
Raffaele Sabato, judges,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above applications lodged on 10 April 2019 and 13 August 2020 respectively,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms Kifayat Hasan gizi Ismayilova, was born in 1951. She was represented by U. Maharramova, a lawyer based in Azerbaijan.
The applicant’s complaints under Article 6 § 1 and Article 13 of the Convention and Article 1 of Protocol No. 1 to the Convention concerning the confiscation of her non-residential property in the framework of the criminal proceedings against her son-in-law were communicated to the Azerbaijani Government (“the Government”).
By a letter of 29 April 2024, the applicant informed the Registry that she wanted to withdraw her applications to the Court as the confiscation order in respect of the property had been lifted and the matter had thus been resolved.
THE LAW
Having regard to the fact that the applications were lodged by the same applicant, the Court finds it appropriate to examine them jointly in a single decision.
In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the applications (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.
Accordingly, the cases should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to join the applications,
Decides to strike the applications out of its list of cases.
Done in English and notified in writing on 18 July 2024.
