THIRD SECTION
DECISION
Application no. 16216/23
S.M.E.
against the Netherlands
The European Court of Human Rights (Third Section), sitting on 5 September as a Committee composed of:
Peeter Roosma, President,
Andreas Zünd,
Oddný Mjöll Arnardóttir, judges,
and Viktoriya Maradudina, Acting Deputy Section Registrar,
Having regard to the above application lodged on 17 April 2023,
Having regard to the decision to grant the applicant anonymity, in accordance with Rule 47 § 4 of the Rules of the Court,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms S.M.E., was born in 1980. She was represented by Mr H.J. Janse a lawyer practising in Groningen.
The applicant’s complaints under Article 3 of the Convention concerning her expulsion to Eritrea were communicated to the Dutch Government (“the Government”).
On 17 June 2024 the applicant’s representative informed the Court that the applicant had been granted a residence permit for the period from 2 May 2018 until 2 May 2023 and a prolongation of the permit valid from 2 May 2023 until 2 May 2028. For that reason, the applicant’s representative asked the Court to strike out the case from its list of cases.
THE LAW
In view of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article 37 § 1 in fine.
Accordingly, the application should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 26 September 2024.
Viktoriya Maradudina Peeter Roosma
Acting Deputy Registrar President
