FIRST SECTION
Application no. 30752/06
Vyacheslav Valeryevich TRILEVICH
against Russia
lodged on 23 May 2006
STATEMENT OF FACTS
The applicant, Mr Vyacheslav Valeryevich Trilevich, is a Russian national, who was born in 1969 and lives in Volgograd.
The facts of the case, as submitted by the applicant, may be summarised as follows.
On 17 December 2004 the Sovetskiy District Court of Volgograd convicted the applicant of theft and sentenced him to one year and six months’ imprisonment.
The applicant appealed. He asked to be brought to the appeal hearing. He was however not informed of the date of appeal hearing which was scheduled for 12 April 2005.
On 12 April 2005 the Volgograd Regional Court upheld the conviction on appeal. The applicant was not brought to the courtroom. His counsel was not present either. The prosecutor attended and made submissions.
On 25 January 2006 the applicant was informed that his appeal had been rejected and given a copy of the judgment of 12 April 2005.
COMPLAINTS
The applicant complains under Article 6 of the Convention that his conviction was unjust, that the domestic courts incorrectly assessed evidence and that the conviction was partly based on his confession made without the benefit of legal assistance. He further complains that he was not informed about the date of the appeal hearing and was not brought to the courtroom.
QUESTION TO THE PARTIES
Given that the applicant was neither present nor represented at the appeal hearing of 12 April 2005 before the Volgograd Regional Court, were the proceedings in his case compatible with the requirements of Article 6 §§ 1 and 3 (c) of the Convention?
