ARBITRATION AND MEDIATION CENTER Alternative Dispute Resolution Proceeding Accelerated Proceeding Case No. DSE2025-0018 1. Petitioner The Petitioner is Scania CV AB, Sweden, represented by CSC Digital Brand Services Group AB, Sweden. 2. Domain Holder The Domain Holder is [Name Removed], Sweden. 3. Domain Name and Procedural History This Alternative Dispute Resolution proceeding relates to the domain name (the “Domain Name”). This Petition was filed under the Terms and Conditions of registration (the “.se Policy”) and the Instructions governing Alternative Dispute Resolution proceeding for domain names in the top-level domain .se (the “.se Rules”). The WIPO Arbitration and Mediation Center (“the Center”) verified that the Petition satisfied the formal requirements of the .se Policy and the .se Rules. In accordance with Section 13 of the .se Rules, the Center formally notified the Domain Holder of the Petition on July 1, 2025. The Domain Holder did not submit any response and, accordingly, the Center notified the Domain Holder's default on August 4, 2025. The Center appointed Monique Wadsted as the sole Arbitrator in this matter on August 12, 2025. The Arbitrator has submitted the Statement of Acceptance and Declaration of Impartiality and Independence, as required by the Center to ensure compliance with Section 1 of the .se Rules. 4. Factual Background The Petitioner was founded in 1891 and registered as a Swedish company with the company name Scania CV AB in 1962. The Petitioner is a world-leading provider of transport solutions, including trucks and buses for heavy transport applications combined with an extensive product-related service offering. The Petitioner is one of the world’s leading manufacturers of trucks, buses and engines for heavy transport applications and also markets and sells a broad range of service-related products and financing services.
page 2 The Domain Name was according to the registration information disclosed by The Swedish Internet Foundation created on May 13, 2025 by the Domain Holder. 5. Claim The Domain Name shall be transferred to the Petitioner. 6. Parties’ Contentions A. Petitioner The Domain Name is identical to the Petitioner’s company name, Scania CV AB, registered in Sweden in 1962. The Domain Name is also similar to the Petitioner's Swedish trademark registration for SCANIA. The Petitioner and its SCANIA trademark are known internationally, with trademark registrations across numerous countries, including Sweden. The Petitioner has marketed and sold its goods and services using this trademark since 1911 before the Domain Holder’s registration of the Domain Name on May 13, 2025. By registering a domain name that fully incorporates the Petitioner’s SCANIA trademark and Scania CV AB company name, the Domain Holder has demonstrated a knowledge of and familiarity with the Petitioner’s brand and business. The fact that the Domain Holder later used the Domain Name to fraudulently register commercial accounts in the name of the Petitioner’s company provides evidence of the latter. The Domain Holder has registered and used the Domain Name solely to impersonate the Petitioner for phishing purposes. The Domain Holder created a fraudulent account with ICA Gruppen, a grocery retailer in Sweden, using the Petitioner’s company name and the email address “[…]@scaniacv.se” with the extension comprised of the Domain Name. The Domain Holder’s efforts to masquerade as the Petitioner certainly constitutes a fraud and must be considered bad faith registration and use of the Domain Name. The Petitioner has not found that the Domain Holder has any registered trademarks or trade names corresponding to the Domain Name. Further, the Petitioner has not found anything that would suggest that the Domain Holder has been using SCANIA in any other way that would provide legitimate rights in the Domain Name. B. Domain Holder The Domain Holder has not submitted any response. 7. Discussion and Findings A. The Domain Name is identical or similar to a name which is legally recognized in Sweden and to which the Petitioner can prove its rights The Petitioner has presented a registration certificate from the Swedish Company Registration Office including that the company name “Scania CV Aktiebolag” was registered in 1994. The Petitioner has thus proven that it holds an entitlement as defined in Paragraph 7.2 of the .se Policy, i.e., that the Domain Name is similar or identical to the Petitioner’s registered right in Sweden. B. The Domain Name has been registered or used in bad faith The Arbitrator finds no indication on the record that might rebut the Petitioner’s claims, i.e., the Domain Name has been registered and used in bad faith by the Domain Holder.
page 3 C. The Domain Holder has no rights or justified interest in the Domain Name Based on the record, the Arbitrator finds that the Domain Holder has no rights or justified interests in the Domain Name. D. Decision The Domain Name shall be transferred to the Petitioner. Monique Wadsted Date: August 22, 2025
