SUBJECT MATTER OF THE CASE
The applicant is a Turkish national who was born in 1968 and lives in Muş. The applicant was the head of the provincial branch of the Democratic Society Party (Demokratik Toplum Partisi) (DTP) in Muş, at the time of the events giving rise to the application. The application concerns criminal proceedings brought against the applicant for disseminating propaganda under section 7 § 2 of the Prevention of Terrorism Act (Law no.3713), on account of his statements that he made on ROJ TV, a Kurdish satellite television channel registered in and broadcast from Denmark, in which he allegedly praised a member of the PKK, an illegal armed organisation, and that member’s offences. At the end of the proceedings, he was convicted as charged and sentenced to a total of two years of imprisonment.
The applicant relies on Article 10 of the Convention.
QUESTIONS tO THE PARTIES
Has there been a violation of the applicant’s right to freedom of expression, contrary to Article 10 of the Convention, on account of his conviction under section 7 § 2 of the Prevention of Terrorism Act?
