N. Ergin Salâhi: İş-bu istinaf, İlk Mahkemenin Zem ve Kadih'ten kaynaklanan davada davacı lehine vermiş olduğu 200 milyon TL'sı tazminata karşı yapılmıştır. İstinafın duruşması için tayin edilen gün, aleyhine istinaf edilen avukatı bir istida dosyalayarak özetle. İlk Mahkemed-eki duruşmayı müteakip verilen hükümden sonra davalı No.1 ve 3'ün ilgili Mahkeme kararı ve/veya Yargı Organı ve/veya Mahkemeye karşı saygısızca ve hakaretamiz yayın ve beyanlarda bulunulduğunu iddia ederek bu hususta istinafın duruşmasında yeni şahadet din-lenmesi veya ibraz edilmesi için müracaatta bulunmuştur. Keza istida ile, ilgili hükümlü tazminatın haciz yolu ile tahsil edilebilmesi girişimlerinin fiili müdahalede bulunularak müsteniflerce engellenmek istenildiği hususunda yeni şahadet dinlenilmesi yön-ünde müracaatta bulunulmuştur. Karşı taraf ise dosyalamış olduğu itirazda bu iddiaları reddederek, sair şeyler yanında, bu yönde İstinaf Mahkemesince şahadet dinlenmesinin uygun olmadığı ileri sürülmüştür.
İstidanın duruşmasına başladıktan sonra, istinaf- eden Müstedaaleyhleri temsilen bulunan avukat, şahadet dinlenmesi ile ilgili istida konularından birini teşkil eden haciz işlemlerinin engellendiği yönündeki iddialar hususunda şahadet dinlenip dinlenemeyeceğine karar verilmezden önce konunun ilkin Anayas-amızın 26 ve 29. maddelerinin yorumunu gerektirdiğini ve Anayasamızın 149. maddeleri uyarınca bu maddelerin Yüksek Mahkemeye, Anayasa Mahkemesi olarak, yorumunun yapılabilmesi için konunun Anayasa Mahkemesine havale edilmesi isteminde bulunmuştur. Müstedi -avukatı ise yorumu istenen Anayasa maddelerinin istida konusunun karara bağlanmasında etken olamayacağını ileri sürmüştür. Ancak herhalukârda haciz işlemlerinin engellenmesi ile ilgili şahadet dinlenmesi isteminden vazgeçtiğini bildirmesi üzerine Müstedaal-eyhleri temsilen bulunan avukat da yorum için Yüksek Mahkemeye Anayasa Mahkemesi olarak havalesi istenen Anayasanın 26 ve 29. maddelerinin istidanın geriye kalan konusu açısından etken olmadığı görüşünden hareketle böyle bir yorum için konunun Anayasa Mahk-emesine havale edilmesi isteminde ısrar etmediklerini beyan etmişlerdir.
Bu durumda önümüzde, sadece istinaf konusu karardan sonra, özellikle; davalı No.1 ve 3'ce ilgili Mahkeme kararına ve/veya Yargı organına karşı saygısız ve hakaretamizce yapıldığı id-dia edilen yayın veya beyanlar hakkında istinaf mahkemesine yeni şahadet sunma istemi kalmaktadır.
Müstedinin istidası Emir 35 Nizam 8'e dayanmaktadır. İlgili Emir ve Nizam tetkik edildğinde, istinaf mahkemesince yeni şahadet dinlenmesine müsaade edilip -edilemeyeceği tezekkür edilirken ne gibi hallerde takdir hakkının kullanılabileceğine dair hükümler içermekte olduğu görülmektedir.
Bu husustaki mevzuat ve ilgili Emir ve Nizamların mehazı 1960'dan önce İngiltere'de yürülükte bulunan Emir 57 Nizam 4'tür.- Bu Emir ve Nizamın ne gibi hallede kullanılabileceği incelenerek yerleşmiş belirli prensipler vazedilmiştir. Bu prensiplerin çoğu davaların ilk mahkeme önünde dinlendiği sırada mevcut olana ancak Mahkemeye sunulması mümkün olmayan ve sonradan istinaf mahk-emesine yeni şahadet olarak sunulması ile ilgilidir. Bu prensiplere burada değinmeyi lüzumsuz görüyoruz. Önümüzdeki konu davanın dinlenmesi ve karara bağlanmasından sonra ortaya çıkan şahadetin istinaf mahkemesine sunulması ile ilgilidir. Bu hususa açıklık- getirebileceğine inandığımız Mulholland and another v. Mitchell 1 (1971) All.E.R. davasına değinmeği faydalı buluyoruz. Atıfta bulunulan bu kararda, p.307 at 312'de, LORD WILBERFORCE şu görüşlere yer vermiştir:
"The terms of the rule show that, as regard-s matters occurring since the trial, no special gorunds need be shown. The matter lies in the discration of the court. But on what principle ought this discretion to be exercised? Such answer as can be given to this question must, in my opinion, be ectract-ed from a consideration of the process by which damages are fixed.
In any case of serious injury, such as the present, and brain injury is the most difficult case, the process of fixing the damages is elaborate, anxious for all concerned, and prolonged. -It may be months or years before the full effect of the injury shows itself, before it can be seen what degree of recovery is to be hoped for, what the prognosis is to be in terms of life expectation, pain and suffering, earning capacity and medical needs.- Since an estimate has to be made covering the plantiff's whole life, it is to be expected that medical men will long hesitate before giving their opinion and that when they do so there will be reservations and qualifications. To obtain from them an opinio-n expressed in such a way that it can form the bsis of a monetary calculation often involves lengrhy regotiation and correspondence. Much may depend on the emphasis of a pharse, and doctors, whose real concern is with treatment, cannot easily be persuaded -to accept a quantitative formula. medical evidence on the two sides may be and often is basically agreeed, but there will remain differing shades of certainty and emphasis on may important matters. The trial judge has to an opinion the best he can, as to t-hese matters, and having done so, to express his opinion in he form of a lump sum or sums. The method commonly used is by applying a multiplier, which involves on estimate of duration and probabilty, to an annual figure of earnings or expences, and small d-ifferences in the parameters may produce large differences in the final award. The fudge has to take into account all the uncertainties, foreseen and unforeseen, of the future; it has been said that the must use a compound of prophesy and speculation.
Th-is abbreviated and over-simplified desription shows at least what limitations must inherently exist to the Court of Appeal's discretion to admit furtheer evidence. It makes it clear that an impossible situation would arise if evdience were to be admitted o-f every change which may have taken place since the trial. In the nature of things medical condition will vary from year to year, or month to month: earning prospects may change, prices may rise, or even fall. If the Court of Appeal were to admit evidence -of changes of this kind (and it must not be overlooked that a facility given to one side cannot be denied to the other), not only would a mas of appeals involve the heraing of evidence, but the Court of Appeal would merely be faced with the same uncertaint-ies as faced the judge, and of which the judge has, ex hypothesi, already taken account. In other words, an appellant's contention that factors such as these have changed sine the trial must, in normal cases, be met with the answer that the judge, in his e-stimate, has already taken account of them."

"It is quite clear from RSC Ord 59, r10, that the Vourt of Appeal has a discreatonary power to admit evidence as to matters which have occurred after the date of the trial or hearing. As was said in Murphy v Stone Wallwork (Charlton) Ltd10, the question w-hether or not the fresh evidence is to be admitted has to be decided by an exercise of discretion, and the question is largely a matter of degree, and there is no precise formula which gives a ready answer. There is, however, to be taken into account in ex-ercising the dicretion an important factor, to which attention has been directed ins everal cases. It is in general undersirable to admit fresh evidebce on appeal, because there ought to be finality in litigation. Intereset rei publicae ut sit finis litium-; Curwen v James11, jenkins v Ricahard Thomas & Baldwins Ltd12 per Salmon LJ and Murphy ve Stone-Wallwork (Charlton) Ltd13. The normal rule in accident cases is that the sum of damages falls to be assessed once and for all at the time of the hearing. When -the assessment is made, the court has to make the best assessment it can as to events that may happen in the future. If further evidence of new events were too easily admitted there would be no finality in such litigation (Curwen v. James14).
That is the- present principle, the present practice. There is much advantage in finality. The case is finished, the claim is settled, and there will normally be no more expenditure of time and money on litigation. Moreover, an end to litigation may in many cases (not- this case, where the injuries are too serious) remove an impediment to a plaintiff's recovery."
-Görülebileceği gibi karardan sonra ortaya çıkan ve istinaf mahkemesine sunulması istenen şahadetin dinlenmesine nadiren müsaade edilmesi gerektiği vurgulanmış ve genelde böyle bir yetkinin kullanılabilmesi için sunulması istenen şahadetin ilk mahkeme kar-arını ortadan kaldırılabilecek veya bunu büyük ölçüde etkileyip değiştirilebilecek esaslı bir şahadet olması gerektiği görüşüne yer verilmiştir.
Önümüzde, sunulması istenen şahadeti değerlendirildiğimizde, ilk mahkeme hükmünden sonra davacıya yönelik har-eketamiz yayınların var olduğu iddia edilmemiştir. Sunulması istenen şahadet, ana hatları ile, Mahkemeye karşı Müstedaaleyhlerce, saygısız ve hakaretamiz yayınlar yapıldığı ileri sürülmekte ve bu gibi yayınların Zem ve Kadih davasına taraf olan davaların k-ötü niyetini göstermek bakımından sunulmak istendiği görülmektedir. Bu durumun kanımızca davacı ile pek ilgisi yoktur. Dolaylı olarak belirli bir ilgisi olmuş olsa dahi, şimdiye kadar yerleşmiş ilkeleri ve özellikle yukarıda alıntısı yapılan içtihat kararı-nı dikkate aldığımızda bu durumu bir istisna kabul edip istinaf Mahkemesine sunulmak istenen şahadetin sunulmasına müsaade edilmesinin uygun olmadığı görüşündeyiz.
Ayrıca şunu da belirtmek yerine olur ki böyle bir şahadetin istinaf mahkemesine sunulmasın-a müsaade edilmesi halinde, ilk mahkeme kararını gözden geçirmekle görevli istinaf Mahkemesinin yargısal işlevlerine ve tarafsızlığına gölge düşürebileceği veya en azından yanlış anlaşılmaya açık bir durum yaratabileceği, bunun da son derece sakıncalı oldu-ğu kanaatindeyiz.
Yukarıdaki nedenlerle sunulması istenen şahadetin sunulmasının faydalı olmadığına, gerekmediğine ve bu nedenle istidanın reddedilmesine karar verilir.
