STATEMENT OF FACTS
The applicant, Ms Y. L., is a Chinese national, who is currently staying in Switzerland, pending her expulsion. The Court granted the applicant that her identity was not to be disclosed to the public (Rule 47 § 4).
The applicant grew up and lived in China. She left the country in 2015. The applicant’s asylum request in Switzerland was denied by the State Secretariat for Migration (Staatssekretariat für Migration), which in addition ordered the applicant’s departure from Switzerland. The applicant was also informed that if she would not leave Switzerland voluntarily, she could be detained and forcibly returned to his home country.
COMPLAINT
The applicant complains under Article 3 of the Convention that, on account of her membership to the Eastern Lightning Church, she would be subjected to treatment in violation of Article 3 when returned to China. She believes, in particular, that she would be arrested upon her return and subsequently detained and tortured by the Chinese authorities.
QUESTION TO THE PARTIES
In the light of the applicant’s claims and the documents which have been submitted, would she face a risk of being subjected to treatment in breach of Article 3 of the Convention if the expulsion order were enforced?
