FIRST SECTION
Application no. 25930/20
Ivan ZOBEC
against Croatia
lodged on 9 June 2020
communicated on 6 July 2021
SUBJECT MATTER OF THE CASE
The applicant was found guilty of causing a road traffic accident and leaving the scene in summary minor offence proceedings. He complains, under Article 6 §§ 1 and 3 (c) and (d) of the Convention, about the overall fairness of the trial, in particular that he was unable to question a witness against him and that the trial court refused to hear a witness on his behalf.
QUESTION TO THE PARTIES
Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 § 1 of the Convention? In particular, were his rights to defend himself and to cross-examine witnesses secured in the summary minor-offence proceedings against him, as required by Article 6 §§ 1 and 3 (c) and (d) of the Convention (cf. Marčan v. Croatia, no. 40820/12, 10 July 2014; Murtazaliyeva v. Russia [GC], no. 36658/05, 18 December 2018)?
